Module 5 Sexual Abuse Detection, Reporting, and Response

An inmate perpetrator may: Stalk or groom another inmate Give extra attention to a more vulnerable inmate Engage in voyeuristic or exhibitionist behavior Have a history of violence or sex crimes Frequently test boundaries Be a “shot caller” or higher status inmate Prefer double-cells Speak or behave aggressively Brag about exploits Frequently change cellmates Demand to be housed with a certain inmate Possible Signs of Inmate Perpetration

A staff perpetrator may: Be in an unusual location with an inmate Socialize or be overly familiar with inmates Call out an inmate at odd times Prefer to be alone with inmates Know too much about an inmate Favor particular inmates Be flirtatious with inmates Change behavior, mood, or appearance Distance him/herself from coworkers Refer to inmates in derogatory or possessive ways Have other boundary problems Possible Signs of Staff Perpetration

What are some ways that inmates might report sexual abuse or sexual harassment that occurs in the jail?

Inmate Reporting [Insert agency policy on inmate reporting of sexual abuse and sexual harassment, retaliation by other inmates or staff for reporting sexual abuse or sexual harassment, and staff neglect that may have contributed to such incidents.]

Possible Reporting Methods [Insert methods available to inmates to report sexual abuse or sexual harassment, including written grievances, verbal or written reports to staff, reports to outside agencies, and third- party reports.]

Corrections officers, police officers, and sheriffs’ deputies must report: Any belief or reasonable suspicion of child abuse or neglect (C.R.S. § ); Any observation or reasonable belief that an at- risk elder (over the age of 75) has been abused or exploited, or is at imminent risk of abuse or exploitation (C.R.S. § ) Mandatory Reporting for Children and At-Risk Elders

Suspected or observed child abuse or neglect must be reported immediately “to the county department, the local law enforcement agency, or through the child abuse reporting hotline system as set forth in section , C.R.S.” Suspected abuse or exploitation of at-risk elders must be reported to “a law enforcement agency not more than twenty-four hours after making the observation or discovery” (§ ). Mandatory Reporting for Children and At-Risk Elders

Corrections officers, police officers, and sheriffs’ deputies are urged to report: The mistreatment, self-neglect, or exploitation of an at-risk adult (C.R. S. § ). At-risk adults include people with physical impairments that impact basic functioning and developmental disabilities that manifest before the age of 22 and are substantial enough to impair functioning, such as mental retardation, cerebral palsy, and autism. Mandatory Reporting for At-Risk Adults

Officials who observe or suspect an at-risk adult has been mistreated, is self-neglected, or has been exploited or is at imminent risk, are urged to report to a county department not more than 24 hours after making the observation or discovery (§ ). Mandatory Reporting for At-Risk Adults

How can staff demonstrate respect to an inmate who discloses sexual abuse or sexual harassment?

Allow inmates to disclose abuse, even if they do not name the assailant(s) or provide detailed information. Take all allegations seriously. Respond to reports professionally and in a timely manner. Follow first-responder protocols and notify a supervisor immediately. Handling Disclosures Professionally

When sharing information about a sexual assault or sexual activity: Determine who has a “need to know” Refrain from talking openly about these reports, other than reporting to supervisors or other officials Maintain confidentiality and only disclose to authorized personnel Protecting Survivor Privacy

[List security staff first responder duties, including: (1) Separate and isolate the victim and suspect(s) involved; (2) Preserve and protect the crime scene until evidence can be collected; (3) Immediately notify a supervisor; and (4) Request that the victim — and ensure that the suspect — not take any actions to destroy evidence, as appropriate, such as washing, brushing teeth, changing clothes, urinating, defecating, smoking, drinking, or eating.] First Responder Duties
