2 The Public Access Counselor Background & History of the PAC:  The Public Access Counselor provides advice and assistance concerning Indiana's public access laws (the Access to Public Records Act and the Open Door Law) to members of the public and government officials and employees.  Governor Frank O'Bannon created the office by executive order in 1998 after a statewide collaboration of seven newspapers found great obstacles in obtaining government information in Indiana.  In 1999, the General Assembly created the office statutorily.

3 The Public Access Counselor Some of the powers and duties of the public access counselor:  Educating public officials and members of the public on the public access laws.  Responding to informal inquiries concerning the public access laws.  Issuing formal advisory opinions in response to formal complaints alleging violations of the laws. However, the counselor may not issue an advisory opinion concerning a specific matter with respect to which a lawsuit has been filed.

4 The Public Access Counselor The PAC Office:  The counselor is appointed by the Governor for four year terms. The terms expire in non-election years, so the PAC terms typically overlap with different administrations.  The PAC office employs the counselor, a legal assistant, and legal interns who assist with investigations and research.  The PAC office also maintains a website, available at where you can find the Handbook on Indiana’s Public Access Laws, prior opinions and answers to frequently asked questions, among other resources.

6 Access to Public Records Act The Access to Public Records Act (“APRA”)  Purpose: “Providing persons with the information is an essential function of a representative government and an integral part of the routine duties of public officials and employees, whose duty it is to provide the information.”

7 Access to Public Records Act Public Agency’s Responsibilities Respond to requests made in person or via telephone within 24 hours of receipt. Respond to mailed, faxed, or ed requests within seven days of receipt. Respond in writing to written requests for records  Best practice for requesters is to submit all requests in writing, and for agencies to respond to all requests in writing.

8 Access to Public Records Act Responding is not necessarily producing the record; requires that the record be should be produced within a reasonable time PACs have considered factors such as  the nature of the requests (whether they are broad or narrow)  how old the records are  whether the records must be reviewed and redacted

9 Access to Public Records Act  The burden lies with the public agency to show the time period for producing documents is reasonable.  TIPS re: voluminous records requests: Communicate frequently. Document communications. Try to negotiate a production deadline from the outset. Release portions of records periodically

10 Access to Public Records Act  The APRA does not require an agency to stop doing business to respond to public records requests. Section 7 of the APRA requires a public agency to regulate any material interference with the regular discharge of the functions or duties of the public agency or public employees. I.C. § (a). However, section 7 does not operate to otherwise deny a requester’s rights under the APRA. I.C. § (c).

11 Access to Public Records Act Denials If denying records, agencies should state reason for denial with citation to specific authority, and give name and title or position of person responsible for denial. I.C. §  TIP: Citing unspecified “privacy laws” or referring generally to “HIPAA” is not sufficient. (Formal Opinion 05-FC-104: agency did not demonstrate that it was a HIPAA-covered entity)

12 Access to Public Records Act Exceptions to Disclosure - I.C. § Section 4(a) categories are confidential  Confidential under federal/state statute  Trade secrets  Confidential financial information obtained, upon request, from a person. Does not include information filed “pursuant to state statute.”  Court records declared confidential under rules adopted by Indiana supreme court (Admin. R. 9)  Social security numbers  Patient medical records created by a “provider.”

13 Access to Public Records Act Section 4(b): Discretionary Exemptions Public employees’ personnel file information Attorney-client privileged communications and attorney-work product Records developed or prepared during discussion in an executive session Deliberative materials - Record that are intra-agency or interagency advisory or deliberative material, that are expressions of opinion or speculative in nature, communicated for purposes of decision making.

14 Access to Public Records Act  If a record contains disclosable and nondisclosable information, the agency shall separate the disclosable material and make it available. I.C. §  However, if the factual material is “inextricably linked” with the deliberative material, the APRA permits the public agency to withhold the factual material.  If an agency does not have a record that is responsive to the request, not required to create or produce a record (APRA = Records, not information).

15 Access to Public Records Act Electronic Mail  A public record is any record, including electronic media, that is created received, retained, maintained, or filed by or with a public agency.  Electronic mail must be available for inspection and copying by the governing body unless an exception to disclosure, based on the content of the , applies.  Electronic mail must be maintained in accordance with records retention schedules, pursuant to I.C Most agencies have their own retention schedules.

16 Access to Public Records Act Copy Fees  Local agencies may charge only the fee schedule adopted by fiscal body and authorized by I.C. §  May not exceed the actual cost for providing a copy of the public record.  Actual cost is the cost of the paper and per page cost for use of the equipment. Actual cost cannot include labor or overhead. I.C. § (d)(2).  Can require advanced payment  Special considerations for electronic maps provided in I.C (j).

17 Access to Public Records Act 09-INF-05  Can be found at 05.pdfhttp:// 05.pdf  Request for Informal Opinion submitted to the Public Access Counselor’s Office in 2009 addressing a variety of issues related to electronic maps.  Electronic maps are public records.  “... a county may not, under I.C. § (g), require the State or any requester to obtain a license or pay copyright royalties to obtain a copy of the GIS mapping data.”  A county may, pursuant to I.C. § (a), enter into a data exchange agreement with the State. If the county refuses to do so, the State may request, and the agency must provide, access to the electronic map pursuant to the general disclosure provisions of the APRA. Under that arrangement, the county could charge the State a fee established pursuant to I.C. § (j) for a copy of the electronic map. If the data is not copyrighted, the agency could charge fees based on I.C. § (g).

18 Access to Public Records Act 09-INF-05  I.C (a) provides that a “political subdivision maintains the right to control the sale, exchange, and distribution of any GIS data or framework data;” however, the same chapter contains a provisions that the language does not supersede the APRA.  …”if the information the state receives from an electronic map, the political subdivision may not limit the State’s use or dissemination of the information.”  Copyright issues.

19 Access to Public Records Act Questions 1) If a local government employee attaches electronic map data to an and the public request was for that record and its associated attachments, would the attached data follow the same disclosure policy as the ? ) If a local government employee receives electronic map data via and attaches the data to their desktop or county server, does the obligation under APRA to disclose change?

20 Access to Public Records Act Answer Public record is defined as any writing, paper, report, study, map, photograph, book, card, tape recording, or other material that is created, received, retained, maintained, or filed by or with a public agency. Answer to (1) is yes, the attachment would be considered a public record Answer to (2) is no, the obligation to disclosure would not change by where the record is electronically saved

21 Access to Public Records Act Questions 3) If local government makes an electronic map layer available on public access GIS site and then removes it, are they obliged to place the data back on the GIS site if the public requests? ) If local government has a public access GIS site and the public requests than an electronic map layer that the government maintains which has never been on that public access GIS site, is the government obligated to add the layer to the GIS site?

22 Access to Public Records Act Answer Answer to (3) is no, but may ease work burden in producing responses to APRA requests. Answer to (4) is no, APRA imposes no requirement that items be posted online.

23 Access to Public Records Act Questions 5) If local government receives a copy of electronic map data that’s maintained by another local government can they deny access to the other jurisdictions data if there is a public request for a copy? ) Are the guidelines a local government can use to determine whether an electronic map layer fall under GEN or GEN of the general retention schedule

24 Access to Public Records Act Answer Answer to (5) is no, based on definition of a “public record” pursuant to APRA.
