USE OF IMAGES Photographers and graphic artists make a living out of creating images. Using their images in presentations and projects without their permission = STEALING!

PENALTIES FOR COPYRIGHT INFRINGEMENT User pays for damage and profits related to use of image Fees range from $200-$150,000 per infringement use User can go to jail

HOW CAN YOU TELL IF AN IMAGE IS COPYRIGHTED? Look for the following 3 items: The symbol © or the word "Copyright” The year when the work was first created. The name of the owner of the copyright. asics/law.html asics/law.html

LENGTH OF COPYRIGHT If image was created after 1977, the image is copyrighted for the life of the artist PLUS an additional 70 years.

FAIR USE “a legal doctrine that portions of copyrighted materials may be used without permission of the copyright owner provided the use is fair and reasonable, does not substantially impair the value of the materials, and does not curtail the profits reasonably expected by the owner” webster.com/dictionary/fair%20use webster.com/dictionary/fair%20use

WHAT DO YOU THINK? As a language arts project, Jerome, a fifth-grade student. is writing a review for his favorite new book, and wants to post this review online for others to read. He thinks it would be helpful to add a picture of the book cover to his review. He goes to publishing companies website and uploads a copy of the book cover photo to his own online book review. Is it legal for Jerome to do this?

WHAT DO YOU THINK? Martha, a social studies teacher, wants to create an online slide show about Dr. Martin Luther King, Jr. for her students. She found and downloaded a wonderful color photo of him that was on a public domain website. Before using this picture in her presentation, Martha wants to convert the picture to black and white to keep with her color scheme. Can she edit a public domain photo?

WHAT DO YOU THINK? The High Museum of Art is opening a new exhibit of paintings by Salvador Dali. Mrs. Adams is planning to take her students there for a field trip and wants to include a photo from the High Museum’s exhibit on her letter to the parents. Is she legally allowed to do this?

WHAT DO YOU THINK? The School of Tomorrow is having a carnival to raise money for its library. Students are using computers to create posters to advertise this event. Many students use images from Microsoft Word’s Clip Art Gallery for this project. Is this legal use?

WHEN IN DOUBT… If you are in doubt as to whether an image is legally usable, it is best to find a public domain alternative instead.

PUBLIC DOMAIN/CREATIVE COMMONS IMAGES Images that can be used for FREE Found on many sites on the Internet allows for searches of photos given Creative Commons licenses

GOOGLE IMAGES Follow these steps to locate images that are legally- usable When searching on Google Images, to to the Advanced Search page At the bottom of the Advanced Search page, locate the dropdown menu next to the “Usage Rights” field Several options are available regarding free usage and allowable modifications
