Protecting Abortion Access for Teens: Defeating Parental Notification in California Sue Baldwin, MD, MPH, Connie Mitchell, MD, Becca Loya, MA, Norma Jo Waxman, MD November 6, 2007 American Public Health Association

Abortion Access in California CA considered a pro-choice state, with broad constitutional right-to-privacy protection Previous efforts by the state legislature to restrict abortion access for teens overturned by CA Supreme Court Attempts to restrict access through ballot initiatives– process through which the people have the power to propose statutes and amendments to the California Constitution

Proposition 73 Parental notification initiative qualified for November 2005 ballot Special election called by Governor Schwarzenegger Campaign for Real Teen Safety– statewide coalition promoting No on 73 Reproductive justice, civil rights, women’s rights groups, students, teachers, nurses, doctors 73 defeated 53% to 47%

Proposition 85 Qualified for November 2006 election Like Prop 73, would amend CA Constitution to require parental notification and a 48-hour waiting period prior to a minor’s abortion Again, broad, diverse coalition defeated the legislation-- 54% to 46% Reproductive justice, civil rights, and women’s rights organizations, labor, clergy, teachers, students, nurses, doctors

Why Doctors Oppose Prop 85 We want families to communicate about medical treatment, but doctors need to be able to be there when they can’t The parental notification initiative is a threat to public health The medical community is united against laws like this because they jeopardize young women’s health and don’t work.
