WIPO ARBITRATION AND MEDIATION CENTER 8 Mediation v. Arbitration Mediation: a non-binding procedure in which a neutral intermediary, the mediator, assists the parties in reaching a settlement of a dispute. Arbitration: a neutral procedure in which the dispute is submitted to one or more arbitrators who make a binding decision on the dispute
