A Call for Action HIV/AIDS & Hepatitis C in Irish Prisons Irish Penal Reform Trust & Merchants Quay Ireland by Rick Lines, MA July 26, 2002

Key Summary Findings The rates of HIV and Hep C infection among prisoners are many times higher than that in the general population. High risk behaviours for the sexual and intravenous transmission of HIV and Hep C are wide spread among prisoners. The Irish Prison Service’s provision of HIV and Hep C prevention measures falls far short of international best practice. Th Irish Prisons Service’s provision of health care services results in inconsistent and inadequate care for prisoners living with HIV/AIDS and/or Hep C.

In total, the current response of the Irish Prisons Service to the HIV and Hep C crisis falls far short of the Service’s own stated objectives, and guidelines set out by the WHO and UNAIDS.

Prevention & Education Access to condoms, full strength bleach, and syringe exchange programmes must be implemented as a matter of urgency. Methadone programmes must be expanded to prisons outside of the Dublin region, and made available to all medically qualifying prisoners. Appropriate HIV and Hepatitis C education must be made mandatory for all prisoners and staff. Increased financial support must be allocated for community-based organisations to enable them to provide educational services.

Care, Treatment, & Support Adequately staffed and resourced health units must be developed in all institutions. We support the finding of the General Healthcare Study of the Prisoner Population, which concluded “that doctors and other health care staff…be available on a full time basis in larger institutions on the same per capita arrangement as a General Medical Service list.” We welcome the Prison Service’s commitment to hiring professionally qualified nursing staff, and recommend that this process continue until qualified nursing staff are in place in all institutions.

Care, Treatment, & Support Prisoners living with HIV/AIDS or Hepatitis C must have access to proper and sufficient nutrition. Prisoners living with HIV/AIDS or Hepatits C must be provided equal and non-discriminatory access to drug therapies and pain management medications. Increased resources must be dedicated, and ongoing training must be provided, to health care staff in all institutions to enable them to meet the unique and evolving needs of prisoners living with HIV/AIDS and Hepatitis C. Community-based health organisations must be facilitated in providing HIV/AIDS and Hepatitis C support and health promotion to prisoners, and increased financial resources must be made available to them for this purpose.

Care, Treatment, & Support Compassionate release provisions for prisoners living with HIV/AIDS and Hepatitis C should be exercised proactively, and earlier in the course of disease progression. No one should be allowed to die in prison from these diseases.

Confidentiality & Testing Confidential HIV and Hepatitis C testing be made easily accessible for all prisoners. Pre- and post-test counselling be made a mandatory component of testing protocol. We welcome plans by the Prisons Service to increase security of prisoner medical information. Ongoing support and education for staff must be provided in an effort to constantly improve institutional confidentiality practices.

A Call for Action There is no doubt that governments have a moral and legal responsibility to prevent the spread of HIV among prisoners and prison staff and to care for those infected. They also have a responsibility to prevent the spread of HIV among communities. Prisoners are the community. They come from the community, they return to it.
