3 FAMILY EDUCATIONAL RIGHTS AND PRIVACY ACT OF 1974 (FERPA)

4 WHAT IS “FERPA”?  FERPA is a Federal law  Also known as the Buckley Amendment  Protects the privacy of a student’s educational records  Applies to all educational agencies or institutions that receive funds under any program administered by the Secretary of Education

5 WHO IS PROTECTED UNDER “FERPA”?  The rights under FERPA apply to eligible students.  An eligible student is an individual who is, or has been, in attendance at Georgia Perimeter College.

6 WHAT ARE A STUDENT’S RIGHTS UNDER “FERPA”?  to be informed about educational records;  to inspect them;  to request an amendment to the records;  to challenge the accuracy of the records;  to prevent unauthorized disclosure of the records;  to file a complaint with the U.S. Department of Education (DOE) about a violation of FERPA;  to waive these rights in writing.

7 WHAT RIGHTS DO PARENTS HAVE UNDER “FERPA”? FERPA gives certain rights to parents regarding their children’s educational records. These rights transfer to the student:  upon reaching 18 years of age, or  attending any school beyond the secondary level.

8 WHEN CAN A PARENT ACCESS A STUDENT’S RECORD?  with the written consent of the student;  in response to a subpoena; or  if student is claimed as a dependent for Federal income tax purposes.  a parent may access student information but may not act on the students behalf except in emergency situations.

9 WHAT ARE EDUCATION RECORDS? All documents, papers, letters, maps, books, tapes, photographs, computer-based or generated information of an institution that:  Contain information directly related to the student, and;  Are maintained by an agency or institution or party acting in its behalf.

10 WHAT IS DIRECTORY OR PUBLIC INFORMATION? “...information contained in an education record of a student which would not generally be considered harmful or an invasion of privacy if disclosed” (1988 Final Regulations). GPC Directory Information includes:  Name, address, and telephone listing;  Major field of study;  Dates of attendance;  Degrees and awards received; and  Full or part-time status.

11 CAN DIRECTORY INFORMATION BE RELEASED TO ANYONE WHO REQUESTS IT? YES – if the student has NOT requested that directory information be withheld. NO – if the student has requested that directory information be withheld, no information can be released:  outside GPC except as provided by law;  to anyone within GPC who does NOT have a need to know.

12 WHAT IS NON-DIRECTORY INFORMATION? Includes: Social Security Numbers Student Identification Numbers Race, Ethnicity and/or nationality Gender Transcripts Grades and grade reports

15 ACADEMIC HONESTY POLICY Georgia Perimeter College recognizes and specifies that students shall not attempt to defraud, deceive or mislead an instructor in arriving at an honest grade assessment.

16 CHEATING/PLAGIARISM Any attempt to defraud, deceive or mislead constitutes cheating. Plagiarism is a form of cheating that involves presenting as one’s own the ideas or work of another.

17 RANGE OF SANCTIONS Sanctions may include the following:  Disciplinary Probation: Probation for a period to be established by the College Court, implying that the individual’s standing within the college is in jeopardy and that further negligent or willful violations will normally result in suspension or expulsion.  Suspension from the College: Separates the student from the college for a specified period of time. Such separation prohibits attendance at any classes, social events or other functions, or visiting college grounds or buildings unless by written permission.  Expulsion: An individual wishing to resume studies after having been expelled must reapply for admission to the college.  Dismissal: An individual who has been dismissed is ineligible for readmission.  Repeat Violations: In the case of repeated violations or violation in deliberate disregard of a specific warning, a student will be subject to more serious sanctions than would otherwise be the case. A prior disciplinary record is never relevant in determining the facts of an incident, but once the facts have been established, it may be relevant in determining the appropriate sanction.

18 STUDENT REGULATIONS & CONDUCT CODES It is a basic and fundamental responsibility of a College to maintain order through reasonable policies and procedures.

19 RULES OF CONDUCT 1. Zero Tolerance – Firearms, explosives, fireworks, or weapons of any kind. 2. The manufacture, distribution, sale, possession, or use of alcoholic beverages, marijuana, controlled substances, or dangerous drugs on the campus and at institutionally approved events off campus is prohibited. 3. No person shall physically abuse, threaten, or intimidate any member of the faculty, staff, student body, or any official visitor to the Campus. 4. The taking, damaging, or malicious destruction of property belonging to the college, to the visitors to the college, or to any member of the college community is prohibited. 5. No person shall assemble on campus for the purpose of creating a riot or disruptive or disorderly diversion which interferes with the normal educational processes and operations of the college. 6. Gambling on the campus is prohibited. 7. No person shall interfere with, fail to cooperate with, or fail to identify him or her self to any properly identified administrator or staff person while that person is in the performance of his or her duties.

20 RULES OF CONDUCT (cont’d) 8. Unauthorized entry into, use, or occupation of college facilities which are locked, closed to student activities, or otherwise restricted. 9. Falsification, alteration, fabrication, or misuse of college forms, documents, records, or identification cards is prohibited. 10. The operation on campus of student organizations not properly registered with and recognized by the Student Life Office is prohibited. 11. The dissemination on campus of publications which do not bear the name of the originator or which are not done in accordance with college rules and regulations is prohibited. 12. Students shall not attempt to defraud, deceive or mislead an instructor in arriving at an honest grade assessment. 13. Hazing is not permitted. 14. Unauthorized use of college property or services is prohibited. 15. Behavior that is disruptive or that interferes with the campus learning process in the classroom or on campus is not permitted.

21 DISCIPLINARY SANCTIONS 1. Admonition or oral statement 2. Official reprimand, warning, or notice in writing that continuation or repetition of wrongful conduct may cause more severe actions

22 SANCTIONS (cont'd) 3. Educational sanction including but not limited to public service, participation in a particular program, receipt of specific instruction, or completion of research assignment. The accused shall be responsible for payment of any required fees.

23 SANCTIONS (cont’d) 4. Disciplinary probation or exclusion from privileged or extracurricular activities. 5. Restitution or reimbursement for damage or loss caused to others. 6. Forfeiture of academic credit.

24 SANCTIONS (cont'd) 7. Suspension or exclusion from classes and other privileges for a definite period of time. 8. Expulsion or termination of student status in the college community. 9. Any and all sanctions are deemed appropriate by the College Court and/or Dean of Student Services.

25 DRUG & ALCOHOL POLICY The manufacture, distribution, possession, or use of alcoholic beverages, controlled substances, in any quantity, on campus and at all Georgia Perimeter College Campus approved events off campus is prohibited.

26 DRESS CODE Appearance and/or dress that are extreme or unusual to the point of distracting from or being disturbing to the learning environment within classes or on campus will not be tolerated. In certain technical labs, student dress is expected to meet all safety codes.
