The Statute of Limitations for a Personal Injury Case

The statute of limitations is a state law that sets strict time limits for filing a personal injury claim in court. Failure to file a personal injury claim within the statute of limitations can lead to dismissal of the claim.

Different states have different statutes of limitation for filing a personal injury claim depending upon the type of claim the plaintiff files. It is enforceable from the time the injuries were sustained.

Exceptions to the Statute of Limitations for a Personal Injury Case There are a few exceptions as to when a personal injury claim can be filed after the standard statute of limitations has expired.

The following are some exceptions: When the injured person did not know that he or she was injured When the injured person did not know that the defendant’s negligent actions may have caused the injury If the defendant leaves the state after the incident If the injured party is a minor, disabled or mentally ill
