Regulatory procedure with scrutiny Council by QMV Parliament by simple majority (376 MEPS) European Commission adopts draft measure Step 1: Committee (comitology) voting Positive vote (QMV) Negative or no opinion Step 2: Submitted to Council and European Parliament (3 month review) Step 2: Submitted to Council (2 months to take decision) 1. May oppose the draft measure if it: exceeds the competences laid out in the basic act is not compatible with the aim or content of the legal act, or does not respect the principles of Subsidiarity and Proportionality 2. Not block the draft measure 1. Oppose the draft measure by QMV Goes back to the Commission (and the Parliament does not have any rights) 2. Adopt the measure (or not find any opinion by QMV) Draft measures go back to the European Commission and the Parliament has no rigths Measures are submitted to Parliament (2 month review) to perform checks as described COM may: amend the draft measure and resubmit it to the Committee present a legislative proposal COM will adopt the draft measure

Delegated Act procedure No formal opinion of a committee needed. EC will be assisted by expert group and might consult other stakeholders. Delegated Act procedure European Commission (EC) drafts delegated act European Parliament (simple majority: 376 MEPs) Council (qualified majority) EP and Council have to object within period set by legislative act. Delegation of power to EC may be revoked at anytime by EP and/or Council Possible outcomes: 1: EP expresses opinions 2: EP does not express objection 3: EP revokes delegation altogether Possible outcomes: 1: Council expresses opinions 2: Council does not express objection 3: Council revokes delegation altogether No objection expressed by EP and Council Objection expressed by EP and/or Council EP and/or Council have decided to revoke delegation The delegated act is adopted and will enter into force The delegated act is not adopted Delegation of power to EC is revoked altogether
