Who is Responsible in a Car Accident?

Motor vehicle laws dictate who is responsible in a car accident. Motor vehicle laws regulate how people should drive their vehicles on public roads. Breaking these laws is seen as negligence.

According to motor vehicle laws, you will be considered responsible in a car accident if you are: Negligent If you are driving carelessly and fail to give the right of way to another vehicle to avoid an accident, you will be held responsible for the car accident.

Reckless If you willfully disregard the safety and welfare of others, you will be held responsible for an accident, even if you are not at fault.

Engaging in Intentional Misconduct If you purposely drive through a red light or drive drunk, you will be held responsible for an accident.

Engaging in Dangerous Conduct If you are driving a defective product or carrying explosive chemicals in your vehicle, you will be responsible for an accident.
