By Katherine Ramirez & Alicia reta First amendment

1st Amendment An amendment to the U.S. Constitution, ranted in 1791 as part of the Bill of Rights, prohibiting Congress from interfering with freedom of religion, speech, assembly, or petition.

Texas vs. Johnson In 1984, (in front of Dallas City Hall) Gregory Lee Johnson burned an American flag for a protest against (Former President) Reagan administration policies. Johnson expression was protected under the first amendment. Johnson was tried and convicted under Texas law (outlawing flag desecration).

Outcome The Texas Court of Criminal Appeals reversed the conviction. Then the case went to the Supreme Court. Johnson was assessed to a $2,000 fine. Also sentenced a year in jail.

"the flag unique statuses symbol of national unity outweighed "symbolic speech" concerns, the government could lawfully prohibit flag burning." -Justice Stevens
