Rights of Children of Undocumented Parents and of Undocumented Children All children have a right to a free, public education; it is illegal for schools to discriminate against students or parents based on national origin, including students and parents that are undocumented. Schools and education-related sites are still designated “safe zones” and are not subject to immigration raids. Children born in the United States are U.S. Citizens and cannot be deported. They have all the rights of a citizen under the Constitution and our laws. Children whose parents are deported may remain in the care of a legal caretaker or may leave the U.S. with their parents.

Families at Risk Should Prepare a Safety Plan Make child care plans, including updating emergency contact info at school and completing a caregiver authorization affidavit. Memorize the phone numbers of friends, family members, and an attorney that you can call if you are arrested. Keep important documents such as birth certificates and immigration documents in a safe place where a friend or family member can access them if necessary. Contact consulate to update child’s information and secure appropriate travel documents for the child. Make sure your loved ones know how to find you if you are detained by ICE using ICE’s online detainee locator (https://locator.ice.gov/odls/homePage.do).
