Western Electricity Coordinating Council Further Examination Question 8: When notified of communications received from governmental or regulatory agencies related to alleged violations or areas of non-compliance, and recommendations from such monitoring activities, the Board oversees the processes developed to address such deficiencies and ensures the Chief Executive Officer (CEO) implements appropriate changes to remedy any identified problems to an approved schedule. Clarification Request for clarification regarding WECC subjectivity to alleged violations. WECC is not a Registered Entity therefore is not subject to compliance with Reliability Standards or “alleged violations” in that sense WECC is obligated under other regulatory jurisdiction and subject to audits and potential investigations – including NERC, FERC, OSHA, etc. NERC review of WECC implementation of bylaws and Rules of Procedure, evaluation of activities related to the delegation agreement, FERC audit of accounting for financials, OSHA, HIPPA Western Electricity Coordinating Council

Western Electricity Coordinating Council Further Examination Question 14: The Board considers whether standards, obligations, processes, and decisions WECC imposed on its Members are timely, fair, effective and reasonable in view of the commercial, legal, regulatory and economic needs and objectives of the effected members. Clarification Request for further review Board agenda’s and discussion do not include substantive review of potential impacts on members Improved communication/ transparency where it does occur NOTE: WECC Operating Plan provides a value proposition to provide efficient and effective risk based CMEP. NERC has an initiative conduct a comprehensive review of the Reliability Standards to ensure they are necessary for reliability and security.
