What is IP? Two “families’ of IP: Registered IP and Non-registered IP Registered IP requires an application to the IP Office who will assess the application and make a decision if the invention, trademark or design meets the requirements for registration: Patents protect inventions i.e. how things work Trade marks protect brands, names and logos Designs protect the way something looks i.e. the ornamental or aesthetic aspect of an article Geographical Indication (GI) is a sign used on products that have a specific geographical origin and possess qualities or a reputation that are due to that origin Plant Variety Protection protects new varieties of plants

What is IP? IP that does not require registration (in most countries): Copyright is a legal term used to describe the rights that creators have over their literary and artistic works. Works covered by copyright range from books, music, paintings, sculpture, and films, to computer programs, databases, advertisements, maps, and technical drawings. In the majority of countries, and according to the Berne Convention, copyright protection is obtained automatically without the need for registration or other formalities.

Why is IP an Important Business Tool? For the SME, IP can: become a valuable financial asset that can bring in new revenue streams be used as a basis to secure finance deter counterfeiters and imitators reward innovation and creativity

How to Register IP The IP system is based on national IP laws and procedures As a result to obtain protection for an invention (patent or utility model), trademark or design you need to apply to the National Office of Intellectual Property (NOIP) The NOIP will assess the application based on Vietnamese law and decide whether or not to grant you the right The right will have effect in Vietnam only To obtain protection overseas is where the World Intellectual Property Organization (WIPO) plays a role…
