GAC in Nomcom Working Group ICANN56 Helsinki , June 2016 Agenda Background WG Work Plan Different scenarios of GAC participation in Nomcom Draft criteria for revision by WG Next steps

Background: Composition of the Nomcom Present: 15 voting members 5 ALAC 7 GNSO 1 ccNSO 1 ASO 1 IAB(IETF) 3 non-voting members GAC (non voting) SSAC RSSAC 1 non-voting Chair 1 non-voting Chair-elect 1 non-voting Associate Chair New proposal expanded to 23 -25 5 ALAC 4 GNSO 5 ccNSO 5 ASO 1 IAB(IETF) GAC: up to 3 voting members SSAC RSSAC IETF (IAB) 1 non-voting Chair 1 non-voting Chair-elect 1 non-voting Associate Chair

Leadership positions selected by Nomcom Board: 8 members (half of the ICANN Board) GNSO: 3 members ccNSO: 3 members ALAC: 3 members

Source: Icann Website

Background: Challenges Equal footing for participation of Governments in ICANN Multistakeholder model Governmental perspective in the selection of the ICANN leadership roles Limitation: Confidentiality requirements for GAC representatives in the Nomcom Limitations for government representatives to be selected as voting ICANN Board members Linked to a broader discussion about accountability and the balance participation of governments in ICANN

Possible Scenarios for GAC Participation in NomCom (1) The Status Quo: Retain one non-voting position but do not fill it pending further developments. PROS: Could be used as an opportunity for greater engagement with any further review process within ICANN. CONS: Many GAC members have said they want some change to the current position.

Possible Scenarios for GAC Participation in NomCom (2) Fill the vacant position but limit it to simple reporting. PROS: Would allow a GAC nominee to monitor NomCom discussions and report on all developments except those involving candidates’ personal information. GAC could provide general feedback to the nominee without a formal voting position. CONS: Reporting to GAC would be constrained by NomCom rules. Not clear how much value a GAC nominee would add to the NomCom process; nor how much could usefully be discussed among GAC members.

Possible Scenarios for GAC Participation in NomCom (3) Fill the vacant position and actively apply GAC-agreed criteria. PROS: Would provide a means of ensuring that NomCom discussions include consideration of GAC criteria, but avoid problems of how a GAC nominee could decide how to vote. Would be consistent with approach of ALAC and ccNSO. CONS: Some GAC members have signalled problems (including sovereignty and confidentiality) with giving any workable mandate to a GAC nominee to the NomCom.

Possible Scenarios for GAC Participation in NomCom (4) Do not take up any position for the immediate future, but submit GAC-agreed criteria to the NomCom. PROS: Would avoid any problems with selection of a GAC nominee and determining a mandate. CONS: Relies on NomCom members applying GAC criteria rather than direct GAC involvement in NomCom discussions.

Will there be a new structure for Nomcom? New proposal expanded to 23 -25 5 ALAC 4 GNSO 5 ccNSO 5 ASO 1 IAB(IETF) GAC: up to 3 voting members SSAC RSSAC IETF (IAB) 1 non-voting Chair 1 non-voting Chair-elect 1 non-voting Associate Chair Request information to ICANN about the statues of possible changes to the Nomcom structure

GAC criteria The personal qualities and experience identified by the ICANN Board in its advice to the NomCom of October 2014. Experience and skills in working to achieve public policy outcomes. Geographic, gender and linguistic diversity. ccNSO and ALAC criteria to be considered.

ccNSO Criteria For ccNSO Council appointments Strongly advise not to appoint members who are directly or indirectly associated with a ccTLD manager; nor Board member or employee of a Regional Organisation (to maintain the balance) Candidate should be able to commit sufficient time to ccNSO work   For Board appointments No specific advice.

ALAC Criteria Description 1 – Invitation for Statements of Interest Document The 5 ALAC members selected by NomCom shall include one citizen of a country within each of the 5 ICANN regions Experience and skills in gathering, understanding and communicating the interests of individual users would be advantageous Basic knowledge of the DNS Time commitment – estimated Description 2 – NomCom Leadership Positions document Experience and skills in gathering, understanding and communicating the interests of individual users Consumer protection/advocacy Internet-related policy development Interest in and knowledge of Internet governance issues Leadership experience in DNS activities Ability to bring new perspectives Strong local networks - Ability and interest to work in a multicultural environment
