Manny Is warrantless tracking of cell phones permitted because citizens have no reasonable expectation of privacy in their cell phones’ whereabouts and their Fourth Amendment rights are not violated when the phone company reveals to the government its own records that show where a mobile device placed and received calls?   No, even though precedent from the 1970's hold that the Fourth Amendment does not protect records held by third parties, in this case cell phone records are invasively collected and citizens do not knowingly expose their location information and thereby surrendering Fourth Amendment protection whenever they turn on or use their cell phone.
