The Family Unit

Marriage

Objectives and Targets I can list and explain some of the issues people need to consider before getting married. I can state the legal requirements for marriage in my state. I can analyze a situation to determine if a couple has met the legal requirements for a valid marriage.

Questions to consider before getting married… Do you really want to get married? Will the marriage be conducted by a civil union or religious union? Will there be a prenuptial agreement (or is one necessary)? Will either of you change your surname? Whose last name will children carry? How will housework and bills be handled? How will the estate be divided in the event of death? Do you reside in a community property state?

Legal Requirements for Marriage in Kentucky A union of two people Whom are of a man and a woman (KRS 402.005 & KRS 402.020) Neither can currently be married to a different living person. Neither of whom are under the age of sixteen (or if either is over 16 but under 18 but does not have the consent of a legal guardian.) Not related any closer than second cousins (either by whole or half-blood) Consensual and without fraud

Situational Analysis Jane and John are in love. John is 18 years-old and Jane is 17 years-old. John asked Jane at their High School Prom. They have not told Jane’s parents that they are getting married. Jane’s parents are close friends with John’s parents and they are certain that their parents will be pleasantly surprised when they announce their union after church on Sunday. ________________________________________

Situational Analysis Alexis and Mike have been planning their wedding for 10 years. They met in their Junior year of college. While completing the guest list for their wedding Alexis discovered that Mike’s great-great grandfather was her great-great grandmother’s brother. ____________________________________

Legal Requirements continued… Kentucky has not changed the statutes to comply with the Supreme Court ruling. (KRS 402.045). What does this mean for same-sex couples who have been married in Kentucky under the Supreme Court’s ruling of legality?

Separation and Divorce

Things to consider before getting a divorce: Separation Divorce Still financially responsible for each other Separation Agreement Once signed by both husband and wife it is a legally enforceable contract. May be made part of the divorce decree. Things to consider before getting a divorce: Cost Children Is the marriage irreparable?

Before you go… Should a couple remain married if they believe the marriage is irreparable, but they have children? Why or why not?
