THE SUPREME COURT DECISION IN US V. TEXAS The decision released on Thursday, June 23, 2016 in US v. Texas was a 4-4 tie

THE SUPREME COURT DECISION IN US V. TEXAS The block of the Deferred Action for Parents of Americans and Lawful Permanent Residents (DAPA) and the expansion of the Deferred Action for Childhood Arrivals program (DACA) remains in place

WHAT DOES THE DECISION MEAN? People cannot apply for DAPA nor expanded DACA BUT the 2012 DACA program is still in effect People can continue to apply and renew DACA

WHAT DOES THE DECISION MEAN? The immigration enforcement priorities that indicate who is prioritized for deportation are still in effect People eligible for DAPA & DACA are not an enforcement priority: they should not be detained or deported

Is this the end of the case? No. The lawsuit will continue in the district court (in Texas) to decided whether DAPA and expanded DACA are legal. The federal government could ask the Supreme Court to hear the case again once there is a 9 th justice appointed to the Supreme Court BUT, it will take months and possibly years for the case to possibly go back to the Supreme Court DAPA

What can we do without DAPA and expanded DACA? Visit a trusted legal services representative to see if you are eligible for the 2012 DACA program or other immigration relief options Learn what your rights are if approached by ICE Obey the law, stay out of trouble, and don’t leave the U.S. without consulting a trusted immigration lawyer. Do not drive after drinking any alcohol. Make your voice heard, get involved. The fight continues!

DACA ELIGIBILITY A person may qualify for DACA if: (1)S/he has lived in the U.S. since at least June 15, 2007, to the present; (2)S/he came to the U.S. before her 16th birthday; (3)S/he was born after June 15, 1981; (4)S/he had no immigration status on June 15, 2012 (and no immigration status when she applied for DACA) and (5)S/he graduated high school; got a GED; or is currently “in school.” A person may go back to school or take classes to qualify. Not all schools or classes may qualify. 8

DACA ELIGIBILITY Don’t forget! Youth become eligible for DACA when they turn 15 ●Youth under 15 who qualify for DACA are eligible if they are in immigration court proceedings If you did not finish high school, you can enroll in an adult education or language class to become eligible for DACA -Make sure that you attend a trustworthy program!

ELIGIBILITY FOR OTHER FORMS OF IMMIGRATION RELIEF Did you know that 14% of people eligible for DACA were found to be eligible for other immigration relief options, too? Other immigration options may help people get a work permit, protection from deportation, and in some cases, lawful permanent residence (a “green card”) Speak to a lawyer or BIA accredited representative to see if you are eligible for other immigration relief options

KNOW YOUR RIGHTS Immigrants, including those who are undocumented have rights when confronted with law enforcement and immigration People who don’t fall into the enforcement priorities should not be deported People have a right to remain silent if approached by immigration At home, people have a right to not allow immigration to enter their home Never sign a document you do not understand

WHAT CAN OUR COMMUNITIES DO NOW? Get out and vote. If you can’t vote, encourage your family and friends to make their voice heard by voting Encourage eligible lawful permanent residents to become U.S. citizens Volunteer at citizenship clinics Organize! We must continue to be involved in the process. Elected officials need to hear from us about issues that matter and affect our communities.

THE FIGHT CONTINUES Remember that DACA and DAPA were our (community’s) victory and only possible because we made it happen and we must continue to be involved to ensure protection for our community and families We will continue to fight for DAPA & expanded DACA to be implemented
