The ILO Recommendation on HIV and AIDS (No.200) S. Mohammad Afsar Senior Technical Specialist ILO Programme on HIV/AIDS and the World of Work (ILO/AIDS)

 Is the first international labour standard on HIV and AIDS  Builds on the ten key principles of the ILO Code of practice (2001) and other international instruments  Addresses developments in the epidemic since 2001  Provides for inclusion of the workplace as an essential element of the HIV response HIV and AIDS Recommendation, 2010 (No. 200) The HIV and AIDS Recommendation, 2010 (No. 200)

 HIV is a workplace issue  No discrimination  Gender equality  A safe and healthy workplace  Social dialogue  No mandatory testing or screening  Confidentiality and non- disclosure  Right to continue in employment (reasonable accommodation)  Equal access to HIV prevention, treatment, care and support services for workers and their families  Prevention as a priority  Protection of workers in occupations at risk of HIV transmission Key Principles: Building on the ILO Code of practice

Scope of application of Recommendation No. 200  All workers working under all forms or arrangements and to all sectors of economic activity (public and private sectors, formal and informal economies)  Workers: job applicants, job seekers, person in training (interns, apprentices and volunteers), laid off or suspended workers  Armed forces and uniformed services

Recommendation No. 200 calls for:  Development of tripartite workplace policies on HIV and AIDS and on occupational safety and health  To provide for access to prevention, treatment, care and support measures in and through the world of work  Integration of world of work in the national AIDS response

The engagement of Employers’ & Workers’ organizations Governments should adopt national policies and programmes on HIV and AIDS and the world of work in consultation with the most representative organizations of employers and workers. The policies and programmes should be given effect, in consultation with employers’ and workers' organizations. Organizations of employers and workers should promote awareness of HIV and AIDS, including prevention and non- discrimination, through the provision of education and information to their members.

Follow-up National mechanism to develop, implement and monitor national policies on HIV and AIDS: - Consultations with Employers’ and workers’ organizations - Consultations with Persons living with HIV Informed policy-making: - Research on national & sectoral developments - Data collection to inform national HIV strategies Reporting to ILO: article 19 of the ILO Constitution

Implementation of Recommendation No. 200  Available in 28 languages  Over 30 national workplace policies on HIV and AIDS developed since the adoption of Recommendation No. 200  At least five national court cases upheld that termination based on HIV status is unfair
