Gideon v. Wainwright (1963)

Key Question Does the Sixth Amendment guarantee the right to counsel in all cases? Further, does the Sixth Amendment require government to provide a lawyer to defendants who want one but cannot afford one?

Sixth Amendment “In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the state and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the assistance of counsel for his defense.”

Precedents Powell v. Alabama (1932) “Let us suppose the extreme case of a prisoner charged with a capital offense who is deaf and dumb, illiterate, and feeble-minded, unable to employ counsel, with the whole power of the state arrayed against him, prosecuted by counsel for the estate without assignment of counsel for his defense, tried, convicted, and sentenced to death. Such a result, which, if carried into execution, would be little short of judicial murder.”

Precedents Betts v. Brady (1942) “The Sixth Amendment of the national Constitution applies only to trials in federal courts. The due process clause of the Fourteenth Amendment does not incorporate, as such, the specific arguments found in the Sixth Amendment…”

Gideon’s Petition to the Supreme Court “Comes now the petitioner, Clarence Earl Gideon, a citizen of the United States of America, in proper person, and appearing as his own counsel. Who petitions this Honorable Court for a Writ of Certiorari directed to the Supreme Court of the state of Florida. To review the order and judgment of the court below denying the petitioner a Writ of Habeus Corpus. Petitioner submits that the Supreme Court of the United States has the authority and jurisdiction to review the final judgment of the Supreme Court of the state of Florida the highest court of the state under section 344 (B) Title 28 U.S.C.A. and because the “Due Process clause.”

Unanimous Majority Opinion (1963) “Reason and reflection require us to recognize that in our adversary system of criminal justice, any person haled into court, who is too poor to hire a lawyer, cannot be assured a fair trial unless counsel is provided for him. This seems to be an obvious truth….Twenty-two states, as friends of the Court, argue that Betts was ‘an anachronism when handed down’ and that it should be overruled. We agree.”
