S 2(g) of the Contract Act A void contract is an agreement that is not enforceable by law 2

S 24 It is fraudulent If permitted, it would defeat any law It is forbidden by a law It involves or implies injury to the person or property of another The court regards it as immoral, or opposed to public policy 3

The following agreements are also declared void by the Contract Act 1950 S26 An agreement made without consideration S27 An agreement in restraint of marriage S28 An agreement in restraint of trade S29 An agreement in restraint of legal proceedings S30 An agreement, the meaning of which is not certain S31 An agreement by way of wager 4

In each of the above cases, the consideration or object of an agreement is said to be unlawful. Every agreement of which the object or consideration is unlawful is void. 5
