PENDING LEGISLATION  Senate Bill 396 – currently pending Governor signature Allows outpatient surgery centers (both those who are certified by CMS and those accredited by an AA approved by the Board to obtain 805 information on physicians (both MD and DO), dentists, and psychologists Allows inspections, after the initial inspection, to be unannounced; the AA will provide a 60-day window to the OSS Requires peer review (every 2 years) for all physicians who perform procedures in an OSS even if there is only one physician performing procedures in the OSS AA = Accreditation Agency; OSS = Outpatient Surgery Setting/Ambulatory Surgery Setting

REQUESTED BY BOARD NOT INCLUDED IN SB 396 Requiring the same reporting CDPH licensed facilities have to do for OSHPD under H&S code section 1216 for accredited agencies Requiring initial certifications of accreditation to be valid for only two years, instead of three

ADVERSE EVENT REPORTING  Statistics for 111 adverse event reports received:  Surgical Event: 11 surgeries performed on the wrong body part, inconsistent with the documented informed consent 2 wrong surgical procedures performed on a patient 7 retentions of foreign object in a patient after surgery or other procedure 6 deaths during or up to 24 hours after induction of anesthesia in a normal, healthy patient 55 surgical events identified as “other” ○ 14 of those were perforation issues

ADVERSE EVENT REPORTING  Product or Device Event: 10 Patient deaths or serious disabilities associated with the use of a contaminated drug, device, or biologic provided by the facility 2 product or device event identified as “other”  Care Management Event: 1 patient death or serious disability associated with a medication error 1 patient death or serious disability due to spinal manipulative therapy performed at the facility 12 care management events identified as “other”  Environmental Event: 1 environmental event identified as “other”  5 Unidentified Events
