Cooperation between Border and Asylum authorities in Poland MAJ IWONA PRZYBYŁOWICZ ALIENS DEPARTMENT BORDER GUARD HEADQUARTERS

Authorities competent in the field of asylum proceedings  Border Guard units – responsible for receiving asylum applications  Border Guard Posts  Border Guard Divisions  Border Guard Headquarters (supervising role)  Office for Foreigners – responsible for conducting asylum procedure (first instance)  Refugee Board – responsible for conducting asylum procedure (second instance)

Cooperation in implementing tasks resulting directly from the legal act - receiving application  Border Guard receiving asylum application:  provide with the written information on the whole asylum procedure (rights and obligations of asylum seekers, time limits, procedure of appeal, possibility of being granted legal aid)  inform where the reception centre is located (obligation to be registered there within 2 days)  ensure the medical examination (the doctor issues a certificate which should be forwarded in the reception centre)  ensure transporting to the reception centre if the asylum seeker is: disabled or elder person, single parent or pregnant woman  take the passport in deposit (if available) and hand it over, together with the dossier, to the Office for Foreigners within 48 hours

Cooperation in implementing tasks resulting directly from the legal act – asylum procedure  Office for Foreigners or Refugee Board has to inform the Border Guard authority about issuing the final negative asylum decision (the rejected asylum seeker has to leave Poland whithin 30 days)  The Border Guard starts with the return procedure after these 30 days  The foreigner can apply for supporting his voluntary return within these 30 days  The Border Guard shall finance voluntary return of an rejected asylum seeker

Close cooperation in creating and interpreting law  Elaborating regulations on granting international protection in Poland is in competence of the Office for Foreigners  Border Guard (BGHQs) is responsible for scope concerning receiving asylum applications and for apprehending and detaining asylum seekers  Common working groups  Consulting draft provisions between Office for Foreigners, Border Guard and Refugee Board

Cooperation in trainings  Organising common trainings in asylum proceedings (in the Border Guard training centre)  Common EU fund projects concerning trainings

Official meetings  Co-participating in official meetings organised by Border Guard, office for Foreigners or Refugee Board  representatives of high level are invited to present their opinions  representatives of high level are invited to be up-dated with new instructions / guidelines  representatives of high level are invited to strenghten the cooperation

Nowadays… new tasks regarding increased migration flows in EU  Resettlements (from third countries)  Selection missions to those countries organised by Office for Foreigners  Transportation of migrants organised by Border Guard  Starting with the standard asylum procedure on the territory of Poland (Border Guard responsible for receiving applications, Office for Foreigners – for procedure)  Relocations ( from Member States)  Liaison officer from Border Guard  Receiving migrants in „Dublin procedure” (responsible Office for Foreigners)  Transportation organised be relocating Member States  Starting with the standard asylum procedure on the territory of Poland (Border Guard responsible for receiving applications, Office for Foreigners – for procedure)
