Copyright © Texas Education Agency To Whom Does Private Nonprofit School Participation Apply?  Most private nonprofit school participation requirements apply to both the state level and the local level, but it may only be for certain activities at the state and/or local level  (must carefully review the particular private nonprofit school participation requirements to be sure)

Copyright © Texas Education Agency Where Do the Requirements for Private NonProfit School Participation Come From?  Some requirements come from the authorizing statute Ex: Title IX, Section 9501 of NCLB (Even Start, 21 st CCLC) Title V, Part A Innovative Programs  Other requirements come from EDGAR: 34 CFR (34 CFR Part 76 applies to all state-administered programs administered by the USDE unless the authorizing statute has its own requirements pertaining to private nonprofit school participation or unless the federal NOGA states these sections do not apply (Ex: Title V Part A)

Copyright © Texas Education Agency What Are the Private Nonprofit School Participation Requirements? In general: The grantee must annually contact p-n-p school officials located within the grantee’s boundaries to determine whether the p-n-p school officials desire that their children participate in the federal programs and services For those p-n-p schools that choose to participate, the grantee must provide a genuine opportunity for them to participate in the planning and design of the program services and activities Grantees must provide for “timely and meaningful consultation” with p-n-p school officials during the design and development of programs prior to making any decisions that affect the opportunity of p-n-p school children and teachers to participate (refer to the Private Nonprofit School Participation schedule in the SAS for the consultation requirements)

Copyright © Texas Education Agency What Are the Private Nonprofit School Participation Requirements?  Equitable Services - Private nonprofit schools must be offered equitable services and other benefits (as compared to public school children and teachers) that address their needs under the program.  Equitable means comparable in quality, scope, and opportunity for participation.  Different needs – If the needs are different for p-n-p school children and teachers, the grantee shall provide services that address their needs on an equitable basis  Local Application - The local application contains a schedule pertaining to Private Nonprofit School Participation that must be completed if any p-n-p schools are located within the boundaries of the grantee

Copyright © Texas Education Agency Equal Expenditures – Calculation of Fair Share  Equal Expenditures – Expenditures for educational services and other benefits for private school children and their teachers and other educational personnel must be equal, taking into account the number and educational needs of the children to be served.

Copyright © Texas Education Agency Equal Expenditures – Calculation of Fair Share  Count the number of public school children (or teachers) participating in the federal program  Count the number of private nonprofit school students (or teachers) eligible to receive benefits in the program  Add them together to get total number of students  Divide into the total amount available to get a per student amount (a reasonable amount may be set aside for administering the private nonprofit school program prior to doing this)  Multiply the per student amount times the number of eligible p-n-p school children (or teachers)  This amount is the “fair share” for private nonprofit schools

Copyright © Texas Education Agency Other Requirements Pertaining to P-N-P School Participation Secular, Neutral, and Nonideological Services or Benefits - Educational services or other benefits, including materials and equipment, must be secular, neutral, and nonideological. Services to private school children must be provided by employees of the school district or other public agency or through contract by the public agency with an individual, association, agency, organization, or other entity. Employees or contractors must be independent of the private school or of any religious organization. Employees or contractors must be under the administrative control and supervision of the public agency.

Copyright © Texas Education Agency Other Requirements Pertaining to P-N-P School Participation The public agency must exercise administrative direction and control over federal funds and any property purchased with those funds that benefits p-n-p school children. The public agency must keep title to and exercise continuing control of all equipment and supplies “loaned” to private schools. The public agency must ensure that the private school is using materials and equipment for the approved purposes of the federal program. The public agency must remove equipment or supplies from a private school when the supplies and materials are no longer needed for the federal program purposes or if necessary to avoid unauthorized use of the equipment or materials for purposes other than the particular federal program under which the supplies and materials were purchased. The public agency must ensure that services in a private school supplement and do not supplant services that would otherwise be provided by the private school. NOTE: For these purposes, “public agency” means the nonprofit grantee organization

Copyright © Texas Education Agency Other Requirements Pertaining to P-N-P School Participation  NO FUNDS ACTUALLY EVER FLOW THROUGH TO THE PRIVATE SCHOOL (unless the private school is the actual grantee) – ONLY SERVICES, MATERIALS, AND EQUIPMENT ARE PROVIDED  The grantee orders the equipment and materials, pays for them, and “loans” them to the private school for the duration of the project.  The grantee maintains any computers, equipment, library books, or other capitalized items on their inventory and shows the location as the private school.
