AUTHORITY FOR A MILLAGE INCREASE Subsection (2) of Section , Florida Statutes (2009) as revised by Chapter , Laws of Florida, provides in pertinent part that: 2

AUTHORITY FOR A MILLAGE INCREASE MILLAGE AUTHORIZED NOT TO EXCEED 4 YEARS. The district school board, pursuant to resolution adopted at a regular meeting, shall direct the county commissioners to call an election at which the electors within the school district may approve an ad valorem tax millage as authorized under s (9). 3

AUTHORITY FOR A MILLAGE INCREASE Election cannot be held more than once in any 12-month period. Any millage increase cannot be levied for a period longer than 4 years. Any millage increase cannot be levied for a period longer than 4 years. District is responsible for providing ballot language that conforms to Florida law 4

Limitations on Ballot Language B. ELECTION EXPENSES Subsection (7) of Section , Florida Statutes (2000) provides that: The cost of the publication of the notice of the election and all expenses of the election shall be paid by the district school board. However, because this proposal will be included in the 2010 General Election the OCPS will not incur any costs associated with a special election. 6

Proposed Ballot Language BALLOT TITLE: Orange County School District AD Valorem Millage Election BALLOT QUESTION: Shall the Orange County School district ad valorem millage be increased by a total of one mill for essential operating expenses in order to preserve academic programs, retain highly qualified teachers and protect arts, athletics and student activities beginning July 1, 2011, and ending four (4) fiscal years later on June 30, 2015, with annual reporting to ensure proper fiscal stewardship of these funds to the citizens of Orange County? 7
