5 Issues for the Public Hearing 1. Based upon the present Project Certificate, how has the AWPAR impacted upon traditional harvesting activities in a manner that was not anticipated at the time the Project Certificate was issued? 2. Confirmation of the terms of each 12.8.2 reconsideration requested by: a. The Proponent, and b. The Hamlet

6 Issues for the Public Hearing i.What are the specific changes requested to the Project Certificate? ii.How and when will the public be permitted to use the road, and under what terms and conditions? iii.How will the terms and conditions for public use of the road be communicated and enforced? iv. Will the proposed changes affect the construction of the road? v.Requirements under the Mine Safety Act and/or other worker/occupational safety regulations

7 Issues for the Public Hearing 3. For both 2(a) and (b), what are the potential environmental impacts of the proposed changes to the Project Certificate and the public use of the road under 2 (i-v) above, and how will these be assessed? 4. For both 2(a) and (b), what are the potential socio- economic impacts of the proposed changes to the Project Certificate and the public use of the road under 2 (i-v) above, and how will these be assessed? 5. For both 2(a) and (b), based upon the proposed public use of the road, are the terms and conditions for use within the current Project Certificate sufficient to ensure public safety, and do the Federal, Territorial, or Municipal governments have roles in regulating and/or maintaining the road?

Do the public easements as set out in Schedule 19- 11 (4) and (5) of the NLCA affect the NIRB’s decision on the reconsideration? a. Is the existing AWPAR located in the same location as described in Schedule 19-11 (4) or (5) of the NLCA? 8. Other?

Identification of the issues to be dealt with at the Public Hearing, to include statements which clearly define these issues; 2. The schedule for the Public Hearing exchange of information; 3. Intervenor identification and registration; 4. Technical reports and other documents required for the Public Hearing; 5. Special procedures, if any, to be followed at the Public Hearing; and 6. Any other matters that may aid in the simplification of the hearing.
