Workshop Objectives: Understand methodology limitations Understand methodology limitations Provide forum for discussing solutions Provide forum for discussing solutions Obtain stakeholder feedback: Obtain stakeholder feedback:  Option 1 - Eliminate recycling rates as compliance options?  Option 3 - Identify alternative methodologies that meet specified criteria?

PRINCIPLES FOR MEETING PARTICIPATION Work together to address issues Work together to address issues Participate fully Participate fully Be respective of others' views Be respective of others' views One person speaks at a time One person speaks at a time Must use microphone Must use microphone Avoid interrupting Avoid interrupting Listen attentively Listen attentively Stay on topic Stay on topic Keep comments to the point Keep comments to the point

Board Member Michael Paparian Full-time member representing the environmental community Mr. Paparian is actively involved in:   Product stewardship for e-waste   State agency compliance with diversion mandates, and   Recycled-content product procurement

An RPPC is ALL of the following:  made entirely of plastic;  relatively inflexible, capable of maintaining its shape;  Between eight ounces and five gallons RPPC Program Overview: Definition of an RPPC

Examples of RPPCs: Regulated:Non-Regulated: - soap, detergent- soda, beer, water - clamshell packaging- food, drugs, (non-food) cosmetics - oil, gas additives- hazardous materials, - pesticides

Recycling Rates - Background Board must annually publish the RPPC “all container” and “PET” recycling rates Board must annually publish the RPPC “all container” and “PET” recycling rates Product manufacturers may use rates to demonstrate compliance if: Product manufacturers may use rates to demonstrate compliance if:  “all container” rate = 25% or greater  “PET” rate = 55 % or greater If rates are below thresholds, then the Board may require a certification If rates are below thresholds, then the Board may require a certification

Compliance Methods 1. 25% Post Consumer Resins (PCR) used in manufacture of container 2. 10% Source Reduction (SR) of resins in manufacture of container 3. Container meets criteria for Reuse or Refill [Title 14 CCR 17946.5(3)]

Discussion of Option 1: Eliminate the Recycling Rates as a Compliance Method.  Pursue statutory changes to eliminate the Recycling Rates as Compliance Methods

Benefits of Option 1: More efficiently implement the program: Provide six month advance notice Provide six month advance notice Plan certification with stakeholders Plan certification with stakeholders Conserve resources (time, money, staff) Conserve resources (time, money, staff) Support Collection infrastructure Support Collection infrastructure

Recycling Infrastructure Investment Local Jurisdictions and haulers have invested a significant amount of dollars into collection and processing of recovered materials Local Jurisdictions and haulers have invested a significant amount of dollars into collection and processing of recovered materials Implementation of RPPC program is necessary to support collection infrastructure and markets for processed plastic materials Implementation of RPPC program is necessary to support collection infrastructure and markets for processed plastic materials

Is Recycling Good For California’s Economy? Creates almost five jobs for every 1,000 tons of waste recycled again and again, Creates almost five jobs for every 1,000 tons of waste recycled again and again, Recycling now accounts for 85,000 jobs, generates $4 billion in salaries and wages, and produces $10 billion worth of goods and services annually, Recycling now accounts for 85,000 jobs, generates $4 billion in salaries and wages, and produces $10 billion worth of goods and services annually, Generates $100 million per year in sales tax revenue. Generates $100 million per year in sales tax revenue.

Discussion of Option 3: Develop a simpler methodology for calculating the Recycling Rates, and publish them every four years  Pursue statutory changes to calculate the Recycling Rates every four years using new Waste Characterization Data

Methodology Criteria: Based on independent sources of California specific data Based on independent sources of California specific data Accurate, precise and independently verifiable Accurate, precise and independently verifiable Reflects recycling of regulated containers Reflects recycling of regulated containers Cost effective Cost effective
