AS Law LA2 feedback 2011 Chief Examiner Professor Iwan Davies

June Series Large entry some re sits. Q1 – Precedent. Overall this was well answered. Reference however to case law was sporadic and limited.

June Series Q2 – Magistrates. Most candidates could identify the role and eligibility criteria. Some confused magistrates with juries. Only stronger candidates provided details of the training process. For part b many answers were just a repeat of the source material.

June Series Q3 – EU /ECHR. Unpopular question Poorly answered. Most candidates omitted reference to ECHR. Part (b) – Centres do not appear to be giving correct guidance on declarations of incompatibility, with some candidates interpreting this as an extension of EU law.

June Series Q4 - Statutory Interpretation. Most popular questions. Overall well answered. Few candidates mentioned the purposive approach however. Q4 (b) - Generally good application of rules to the scenario. Application of mischief rule was vague however. Limited application of case law.

Structuring Answers Some weaknesses in the organisation and planning of answers. –Candidates must have a clear understanding of the assessment objectives. –They need to have a clear understanding of what the question/ statement demands.
