3. The Issues – New Freedom Labor Protection Threat to New Freedom Program Consolidation: TLPA supports consolidation of the Elderly and Disabled Specialized Transit Program (Section 5310), JARC (Section 5316) and the New Freedom Program (Section 5317) into the Coordinated Mobility Initiative while maintaining current law pertaining to each program in regards to funding eligibility, labor protection, private operator subrecipient eligibility, and that projects be selected from the locally developed coordinated human services transportation plan.  The bill newly attaches “13c” labor requirements to currently defined New Freedom eligibilities. TLPA Position: A new citation should be inserted that would “hold constant” the New Freedom category of funding as it pertains to its exemption from labor protection under the current statute enacted in SAFETEA-LU.

4. Texting Threat to Transportation Industry Legislation has been introduced in both the House and Senate to ban texting while driving. Examples include:  House legislation (H.R. 3535) was introduced by Rep. Carolyn McCarthy (D- NY-4)  Senate legislation (S. 1536) was introduced by Senator Charles Schumer (D- NY) TLPA Position: TLPA urges Congress to explicitly recognize that state or locally licensed commercial drivers providing for-hire passenger transportation services, as DOT has already done for federally licensed drivers of commercial motor vehicles, may continue to have access to their dispatch service that is necessary for the ordinary conduct of their business. The Issues – Fuel Efficiency Requirement Legislation has been introduced in both the House and Senate that would allow local public entities to impose fuel efficiency requirements on taxis  House legislation (H.R. 3711) was introduced by Rep. Jerrold Nadler (D-NY- 8)  Senate legislation (S. 1741) was introduced by Senator Kirsten Gillibrand (D- NY) Known as the “Green Taxis Act of 2009,” the Senate version was also included in the Kerry-Boxer Climate Change legislation TLPA Position: TLPA urges Congress to not adopt the proposed legislation as it unfairly singles out one small industry that represents approximately one tenth of one percent of all automobiles in the United States to meet these locally developed, specialized vehicle standards.

6. The Issues – RIDE Act On September 29, 2010, Rep. Laura Richardson (D-CA-37) introduced H.R. 6301, the Prevention of Unreasonable Fees Act  The bill’s purpose is “ To clarify the application of section 14501(d) of title 49, United States Code, to prevent the imposition of unreasonable transportation terminal fees.” This is the companion bill to Senator Frank Lautenberg’s (D- NJ) bill introduced long ago TLPA Position: TLPA supports this legislation and is working with the National Limousine Association to have it enacted into law.
