3 TAIEX workshop Beograd, 31.maj 20123 Who is legally responsible? n n Exporters of substances, mixtures or articles has no legal obligation n n EU manufacturer, importer into EU and only representative are the one who have legal obligation n n EU producer of articles/importer of articles

4 TAIEX workshop Beograd, 31.maj 20124 But to export into EU n n Importer is the one who needs to fulfill the legal requirements of REACH and CLP (Classifications, Labelling and packaging) regulations n n The obligations for importers are the same as for EU manufacturers n n There is an option to have an only representative who is appointed by non-EU manufacturer

5 TAIEX workshop Beograd, 31.maj 20125 Importer n means any natural or legal person n means any natural or legal person (‘the legal entity’ established within the EU who is responsible for import. n n In many instances the ultimate receiver of the goods who is responsible for the import.

6 TAIEX workshop Beograd, 31.maj 20126 Definitions: Only representative n n Only representative: means a natural or legal person established in the EU and appointed by a manufacturer, formulator or producer of an article established outside the EU to fulfil the obligatioins of importers (Article 8).

7 TAIEX workshop Beograd, 31.maj 20127 Definitons: substance n n Substance: means a chemical element and its compounds. The term substances includes both substances obtained by a manufacturing process (for example formaldehyde and methanol) and substances in their natural state. n n The term substance also includes its additives and impurities where this are part of its manufacturing process, but excludes any solvent which can be separated without affecting the stability of the substance or changing its composition. n n Detailed guidance on substances and substance identity can be found in the Guidance on substance identification.

8 TAIEX workshop Beograd, 31.maj 20128 Definitions: Mixture n n Mixture: means a mixture or solution composed of two or more substances. n n Typical examples of mixturers under REACH includes paints, varnishes and inks. n n REACH obligations apply individually to each of the substance contained in the mixture depending on whether the individual substances are within the scope of REACH.

9 TAIEX workshop Beograd, 31.maj 20129 Definitions: Article Article: is an object which during production is given a special shape, surface or design which determines its function to a greater degree than does its chemical composition (e.g. manufactured goods such as textiles, electronic chips, furniture, toys etc.).

10 TAIEX workshop Beograd, 31.maj 201210 Obligation to register n n It is always a substance which has to be registered and not a mixture or an article n n Registration is done always per registrant/a legal entity n n Company with more than one legal entity/more than one registration but one submission of a dossier

11 TAIEX workshop Beograd, 31.maj 201211 Obligation to register n n All substances manufactured or imported into (EU) in tonnage ≥ 1 tonne/year/manufacturer or importer n n Substance as such n n Substance (-s) in a mixture n n Substance in an article (in case when the substance is present in an article in quantities ≥ one tonne or more per year/per producer and intended to be released under normal or reasonable conditions)

14 TAIEX workshop Beograd, 31.maj 201214 Which substances need to be registered? “phase-in substances” EINECS list substances manufactured in EU, but not put on the EU market after 1.6.1992 “no longer polimers” “non phase-substances” New substances Substance was not yet put on EU market

15 TAIEX workshop Beograd, 31.maj 201215 Obligation if you are exporting a substance n n Registration by importer or only representative n n If a substance is a “phase in substance” and pre- registration was done by importer or only representative: The registration needs to be done within deadline (depending on a tonnage level ) n n If a substance is a “non-phase in substance” than it has to be registered before to be put on a market. Inquiry process is needed in that case.

16 TAIEX workshop Beograd, 31.maj 201216 Other REACH obligation for export of a substance n n Is the substance you are exporting into EU under Authorisation regime? n n Annex XIV of REACH where Substances which are subject to an authorisation are listed n n Transitional period until when the substance can still be used without an authorisation

17 TAIEX workshop Beograd, 31.maj 201217 Obligation if exporting a mixture n n Exporter to help an importer on data about the content of substances in a mixture is important n n Are they exceeding 1 tonne level? n n If yes, than registration for each individual substance is needed n n If not than you can export into EU your formulation with no obligation to register

18 TAIEX workshop Beograd, 31.maj 201218 Obligation if exporting a mixture n n Is any of the substances subject to an authorisation? n n Is any of the substances subject to a Restriction? n n All substances which are under restriction are listed in Annex XVII n n Importer has an obligation to communicate information down the supply chain

19 TAIEX workshop Beograd, 31.maj 201219 Obligation if exporting an article n n If you have article with intentional release and tonnage ≥ one tonne; registration of a substance is needed n n If no intentional release than NOTIFICATION in accordance to REACH applies n n REACH Article 33 obligation When substance is put on a candidate list and a list is published by ECHA information about a substance has to be communicated if the content is at least 0,1%

20 TAIEX workshop Beograd, 31.maj 201220 Obligation to notify to ECHA n n In accordance with REACH Article 7 n n Any producer or importer of article should notify (a) (a) The substance is present in articles in quantitites totalling over one tonne or more/year (b) (b) The substance is present in concentration ≥ 0,1%

21 TAIEX workshop Beograd, 31.maj 201221 Obligation if exporting an article REACH Article 33 n n This information should be at least the name of a substance “ This article contains …” n n Example of HBCDD substance n n Restrictions which are laid down in Annex XVII of REACH n n Is there a need to make an analysis for all those substances which are included in the Annex XVII?

22 TAIEX workshop Beograd, 31.maj 201222 Pre-preregistration n 1.6 – 1.12.2008 n for phase-in substances n extended deadline for registration for “phase in substances” (2010, 2013 in 2018)

23 TAIEX workshop Beograd, 31.maj 201223 Pre-registration is officially over But in exceptional cases still possible Importer to proof that after 1.12.2008 is for the first time importing of a phase in substance (tonnage≥ 1t/year/manufacturer) Importer to proof that after 1.12.2008 is for the first time importing articles i/u izdelke (substance to be released, ≥ 1tonne/year/ legal entity) At the latest 6 months after production/importing exceeds one tonnage level and At least 12months before relevant transitional deadline for registration. Is there still possible to pre-register after 1. 12. 2008?

24 TAIEX workshop Beograd, 31.maj 201224 Deadlines for registrations Extended deadlines only for Phase in substances if pre- registrated! n n CMR kat. 1,2 > 1 t/l (1.12. 2010) n n R50-53 substances > 100 t/l (1.12. 2010) n n Phase in substances > 1000 t/l (1.12. 2010) n n Phase in substances > 100 t/l (1.06. 2013) n n Phase in substances > 1 t/l(1.06. 2018) Obligation to register are inforced since 1st June 2008.

36 TAIEX workshop Beograd, 31.maj 201236 A network of EU legislation relies on classification in one way or the other 36 Consequences of classification are greater than just a hazard communication label or a safety data sheet in that it also has a direct effect on the management of associated risks. NOTE!The classification system is hazard based. For it to work it is outmost important to keep classification based on intrinsic hazardous properties and not on downstream consequences.
