2 Brown vs. the Bixby Frog Planning Festival Case Facts  Four teens went to a local festival where they bought and consumed alcohol  They left the festival and went to a lake where one of the teens injured their foot  One of them suggests to break into a nearby empty cabin

3 Case Facts  The teens break into the cabin and bandage the injures foot  Two teens get and consume more alcohol from the refrigerator  They begin to “play around”, which results in valuables in the cabin being damaged

4 Case Facts  The owners return to the cabin and spent $100,000 on repairs  The teens were identified and charged with vandalism, paid $400 for restitution, and sentenced to eighty hours of community serves  The Browns sued the planning committee for failure to prevent alcohol sale to teens and causing the damages to their property

5 Case Law  Hacker vs. Anytown American Legion No. 600  When a person consumes illegally obtained alcohol and then causes harm to another person, the seller is liable for the damages if the alcohol contributed to the damages

6 Case Law  Martinez vs. Smith  If someone sells alcohol illegally and the purchaser becomes intoxicated and then harms someone, the seller is liable as long as the alcohol was a contributing factor

7 Case Outcome  The outcome of this case should have been that the Bixby Frog Planning Committee should have been held responsible for the damages done to the brown’s cabin

8 Alcohol Background  Alcohol is the most commonly misused drug  Behavioral changes are: impaired coordination, errors in judgment, impaired learning and memory, sedation, euphoria, anxiety reduction  All changes in behavior result in alcohol’s actions on the brain

9 Alcohol Background  Most adults drink moderately  Moderately is no more than one drink per day for women and no more than two drinks per day for men  Heavy drinking leads to abuse and independence, liver disease, different types of cancer, pancreas damage, damage to the heart and brain, injuries, violence, and other problems

10 Alcohol Background Alcohol often precedes violent events, including vandalism Violent acts, including vandalism, are more likely in an environment where alcohol is readily available The more serious the crime or injuries, the more likely it is that alcohol was involved

11 Alcohol Background  In one year alone, the cost to victims of alcohol-related crimes in the United States was $10 billion  All but seven states have some for of sever liability  Server liability laws permit individuals to sue for damages that happen as a result of alcohol being sold to a minor or a intoxicated person
