2 Member states level The text refers to Member States or to carriers ( transport operators) or terminal management bodies. 1.Members States prerogatives are highlighted as follow: They can exempt domestic regular services during 5 years (renew once only- probably to facilitate uptake by smaller operators) but not on discrimination of tariff or because of disability (Chap 1 Art 2) They can exempt domestic regular services concerning disability-related provisions of the proposed regulation for all or some provisions provided they can ensure that the national law imposes at least same level of protection for the disabled (Chap 3 Art 18). They must inform EC. They shall designate the terminals where assistance is provided (hence not all terminals) (Chap 3 art 12). They shall inform EC of such list They may grant exemption (for a max of 2 years) for driver training related to disability issues (Chap3 Art 16) They shall designate new or existing enforcement bodies responsible for enforcement of this proposed regulation ( Art 27 to 30) and lay down rules on penalties applicable to infringements.

3 Carriers and terminal management bodies… 2. Carriers or terminal management bodies responsibility are as follow: Compensation in case of loss/damage of luggage They must be calculated in accordance with national law, but no lower than 500€per luggage. (Chap2 Art 7) (TRAN proposed €1800-1300 depending on circumstances) as maximum) Reimbursement for cancellation or delays: Where carriers expect more than 120mn delay or cancellation, (Chap 4 Art 19-20) reimbursement is made at full ticket price for part of journey not made or proportional part of full cost of season ticket. Information and complaints (Chap 5 art 23&24) Information is emphasized at all stage of the journey with reasonable delays in case of disruption and must be made available including information on passenger rights. Complaints : a complaint handling mechanism must be put in place by the carrier.

4 … Carriers and terminal management bodies… Rights of disabled persons with regard accessibility [ see Annex 1 and Annex 2] Exceptions to no discrimination because of disability may exist for safety reason or un-proper design of vehicle or infrastructure. But carrier must inform about acceptable alternative service provided by the carrier. Disabled passenger on their side should inform of their needs 2 working days prior to the journey, if not, carrier make all reasonable efforts to accommodate the traveller. (Chap 3 Art 14) Provision of assistance in case of delay superior to 3h doesn’t apply or does it in suburban area? (Chap 4 Art 21) Provision of information in appropriate ways for disabled passengers is much emphasized: – Info on the journey before (including by internet) and during the journey – Info on passenger rights: (Chap 5 Art 24) and includes contact details with enforcement bodies Training of personnel Carriers and terminal management bodies establish disability related training procedures for their driving personnel, and for other personnel including those employed by any other performing party. NB: Member State may grant exemption for driver training for a max of 2 years from ….
