2 Adversaries “Adversaries” means 2 opposing sides or opponents

3 Criminal Law / Court The two Adversaries/opponents are: “The Crown”, crown prosecutor or the “queen” who would be prosecuting the case or placing the charge Versus the accused, the “Defendant”

4 Private Law or Civil law “The Plaintiff (suing) ” versus “ The defendant”

5 QUESTION:Why 2 opposing sides?

6 HOW the adversarial system works!! Each side argues it’s own case. Decides what to present (witnesses, evidence, cross-examining, etc.) MUST be prepared! Decision is based on what is presented only! Judge decides what “Rules of Law” apply USUALLY Judge/jury does not ask questions.
