3 Transport Canada’s Role The Minister of Transport Canada is a Responsible Minister for the environmental assessment of Agnico Eagle Mines Ltd’s (AEM) Meliadine Gold Project. Providing federal expertise and specialist information to the Nunavut Impact Review Board on several key project elements involving the Canada Shipping Act, 2001 (CSA, 2001), the Navigation Protection Act (NPA), the Marine Transportation Security Act (MTSA), and the Transportation of Dangerous Goods Act, 1992 (TDGA). 3

4 Transport Canada Mandate Promotes an integrated transportation system that is safe, secure, efficient, and environmentally responsible. Responsible for transportation regulations, policies and programs designed to enhance the safe operation of aircraft, trains, ships and barges. 4

5 TC has identified the marine transportation regulatory programs relevant to the project proposal, and noted the Proponent’s responsibilities to meet these regulatory requirements. These include programs related to vessel safety, security, pollution prevention, pollution response, marine liability and compensation, and navigation protection. 5 Marine Transportation Safety & Security

6 Navigation Protection The NPA is a federal law designed to approve works on Canada’s busiest waterways while protecting the common law public right of navigation. The NPA will apply to works constructed or placed in, on, over, under, through, or across a scheduled list of waterways. 6

7 Transportation of Dangerous Goods The TDGA and its regulations promotes public safety when dangerous goods are imported, handled, offered for transport or transported. The program works to prevent incidents and provide strong support to emergency response. 7

8 Summary of Final written Submission TC has reviewed the Final Environmental Impact Statement (FEIS) and provided references or justifications for specific issues noted, and recommendations. –Marine environment –Oil Pollution Emergency Plan (OPEP) –Navigation Protection –Transportation of Dangerous Goods 8

9 TC recommends AEM ensure that the proposed mitigation measures employed by vessels when approaching marine wildlife are, ’subject to safe navigation considerations as determined by the Master of the vessel’. TC recommends that AEM must provide an updated and compliant Oil Pollution Emergency Plan (OPEP) to TC prior to the commencement of the Project. 9 Summary of Recommendations

10 Marine Transportation Security Regulations (MTSR) require AEM to notify TC who was awarded the contract for shipping services associated with the project. TC recommends that AEM abide by the TDGA and its regulations as they relate to project operations. 10 Summary of Recommendations

11 The comments and recommendations provided by TC reflect our mandate as defined by the relevant legislation administered by TC. TC generally agrees that the conclusions contained within the FEIS are supported by analysis, as the documentation provided during the review reflects that AEM has identified the need for compliance with the applicable regulations. 11 Closing Remarks
