Types of Milk Offered  Prior to Reauthorization, SFA’s had to base their milk offerings on “prior year preference.”  Whole milk is no longer required.  Now, must offer “a variety of fat content.”  May offer flavored and unflavored and lactose-free fluid milk.  Memo on the PEARS Form Download Menu, PDE039. 6.  May substitute a non-dairy beverage that is ‘nutritionally equivalent’ for ‘medical or other special dietary needs’ (not a disability) when requested, in writing, by a recognized medical authority or a parent or guardian. 7.  Must be in writing, PEARS Memo, Form Download, (PDE015).  Expenses incurred in providing substitution in excess of expenses covered by program reimbursements are paid by the school district. 8.  The substitution is “nutritionally equivalent” to milk as determined by USDA (must include calcium, protein, vitamins A & D).  SFA must notify SA if implementing the non- medical option. 9. Finally, Section 102 prohibits restrictions on the sale or marketing of fluid milk (directly or indirectly) on school premises or during school events. This is to prevent contract limitations on the sale of milk in competition with other beverages.
