3. The National Transportation Safety Board consists of 5 Members, appointed by the President, including a Chairman designated by the President, by and with the advice and consent of the Senate. Members serve 5-year staggered terms.

4. A Member is also designated by the President to serve as Vice Chairman. The Chairman and Vice Chairman serve 2-year terms.

5.  Three Members of the Board constitute a quorum

Board Members rule on the suspension, amendment, modification, revocation, or denial of any operating certificate or license or assessment of civil penalty issued by the Secretary of Transportation and the decisions of the Commandant of the Coast Guard, on appeals from the orders of any administrative law judge, revoking, suspending, or denying a license, certificate, document, or register in proceedings
