Student Workers - immigration update Time off for Training Annual Leave/sick leave

2 Fit Notes – 6 April 2010 Fit note replaces medical certificate
Does not need to state fit for work before employee returns GP advice general to the condition and not job specific Does not replace occupational health advice which is specific to job Not obliged to implement doctor’s recommendations if not feasible If condition covered under DDA -careful consideration must be given to reasonable adjustments Refer to OH if ‘not fit for work’

3 Student Workers – Immigration Update 3 March 2010
Students on a Tier 4 visa submitted on or after 3 Mar 2010 and studying at below degree level, may only work 10 hours pw during term time and full time during the university vacation period. Students on a foundation degree, courses at degree level or above, may continue to work 20 hours pw during term time and full time during the university vacation period. You must check the level of the student’s course before appointing to 20 hours pw and confirm on SiP Care needed with ‘as and when’ offers of work

4 Time off for Training – 6 April 2010
UCL committed to training & development – should be discussed at appraisal Study Assistance Scheme available New right to request unpaid time off for relevant training Process similar to considering requests for flexible working Must give serious consideration No obligation to pay for the training or for paid time off Acceptable reasons to reject include: training not relevant to job; cannot meet costs of cover; detrimental effect on service provision etc. Procedure in draft

5 Annual Leave / Sick Leave - immediate
Statutory entitlement (28 days) to paid annual leave continues to accrue during sick leave, even if the employee is on sick leave for the whole year and does no work Employees can take their statutory annual leave at the same time as sick leave and receive their normal rate of pay, or can carry over statutory leave to the next year Payments in lieu of leave upon termination of employment must include any untaken statutory annual leave even if the employee has been on sick leave for the whole of the leave year Annual leave policy updated
