3 JACK O’CONNELL State Superintendent of Public Instruction Title III Program and Fiscal Update Title III Apportionments Next apportionments for the 2007-08 and 2008-09 funding cycles are now being processed for those who met cash management thresholds as reported on the 2009-10 ConApp, due June 30, 2009. Only Local Educational Agencies (LEAs) that verified that they have expended or encumbered at least 80 % of previous apportionments receive apportionments.

4 JACK O’CONNELL State Superintendent of Public Instruction Title III Program and Fiscal Update Applications for Funding for Fiscal Year 2009-10 Direct-funded LEAs (LEAs whose estimated subgrant is greater than or equal to $10,000) should have submitted their applications for the Limited English Proficient Student (LEP) funding subgrant program and Immigrant Education Program funding subgrant program on the 2009-10 Consolidated Application (ConApp).

5 JACK O’CONNELL State Superintendent of Public Instruction Title III Program and Fiscal Update LEAs whose estimated subgrant is not equal to or greater than $10,000 must apply via a consortium application. The application is web-based and will be accessible in late September or early October. For details, please visit the Title III Web site at http://www.cde.ca.gov/sp/el/t3/ Each LEA will be required to enter a Password and Pin. LEA Passwords and Pins will be provided separately in two letters that will be mailed in September.

7 JACK O’CONNELL State Superintendent of Public Instruction 2009-10 Award letters The Title III allocation is estimated at $95 for both the LEP funding subgrant program and Immigrant Education Program funding subgrant program. LEAs will be receiving award letters and allocation information for fiscal year 2009-10 this fall.

8 JACK O’CONNELL State Superintendent of Public Instruction End of Year Reports Each LEA is required to submit an End-of-Year expenditure report on all Title III expenditures for the LEP student subgrant program and the Immigrant student subgrant program. The End-of-Year Report is due October 30, 2009 and is anticipated to be available online as of September 30, 2009. Access to the report will be available through the Title III Web site located at http://www.cde.ca.gov/sp/el/t3/

9 JACK O’CONNELL State Superintendent of Public Instruction Definition of Immigrant Students As stated in the Elementary and Secondary Education Act (ESEA), Sections 3301 (1), (6) and (14), the definition of an immigrant student is:  (A) Aged 3 through 21;  (B) Not born in any State; and  (C) Have not been attending one or more schools in any one or more States for more than 3 full academic years. “State” is defined as the 50 States, the District of Columbia and Puerto Rico The immigrant students reported on the SNOR during the 2009-10 school year will be used to determine eligibility in the 2011-12, 2012-13 and 2013-14 school years.

12 JACK O’CONNELL State Superintendent of Public Instruction Community-Based English Tutoring Program (CBET) Pursuant to a recent budget bill, CBET funding for the period of 2008-09 through 2012-13 may be used for any educational purpose. All program requirements are suspended during this flexibility period. CBET funding for the period of 2008-09 through 2012- 13 will be based on 2008-09 allocations, rather than on English learner counts. Apportionments will be processed by the School Fiscal Services Division. Payment schedules have not yet been determined. Apportionment amounts for 2009-10 can be calculated by multiplying the LEA’s 2008-09 apportionment by.94727.

13 JACK O’CONNELL State Superintendent of Public Instruction English Language Acquisition Program (ELAP) Funding used to provide supplemental services to English learners in grades 4-8. Funding available for 2009-10 school year is $50,549,000, divided among 483,165 eligible pupils. Eligible LEAs per-pupil rate is $104.62. Apportionment letters were mailed early September.
