2 12 Rational for Costing Section 35 of the PFMA in terms of unfunded mandates requires: - memo to be introduced to Parliament with draft legislation that gives projections of the financial implications for province, especially as it relates to the - power or obligations for provinces Current scoping exercise does not deal with financial implications, but rather identifies what ought to be costed. Costing allows the Executive and Parliament to make:- - policy choices - budgetary choices - service delivery choices This aids in planning for the 3 year MTEF cycle and budgets Costing needs to take into account the different levels of service delivery, that is whether service should be –Basic –Intermediate –High level, but also define what each level means

A cost matrix that reflects the different types of service- delivery, administration & organisational and financing obligations on the different spheres of Government Including whether these obligation directs the particular sphere towards the: –Provision of services –Development of new projects and or programs –Required level of service delivery for protection and care of Older Persons at level.  Household  Community  Institutional  Facility

4 14 Current Services to Older Persons Government currently provides non- contributory pensions (old age and war veterans) to –More than 2 million –In –year cost of close to R11 b –Old age pensions (60/65) female and males –Programme funding support to Non-profit organisations through:  Subsidies and other forms of support by provincial social welfare departments

5 15 Scoping and Financing Issues contained in the Bill Bill identifies: –A number of service delivery programmes and services which require not only costing, –But, also a determination of the extent of programmes and services Who qualifies for these services and programmes? Need to define concepts such as: -Facilities - Frail persons -Older persons

6 16 Scoping and Financing Issues contained in the Bill Chapter 1 in particular identifies a number of programmes which require detail costing:- –Establishment and funding of organisations –Provision and resourcing of additional facilities and services –Rights of older persons –Norms and standards requirements for policies, services and facilities –Utilisation and management of existing facilities for older persons

7 17 Scoping and Financing Issues contained in the Bill Provision of accommodation for older persons –Possibly consider an alternative such as rather strengthening families and communities to care for each older person Improving free access to older persons: –Health (which level of health care?) –Welfare – (what type of welfare services?) –Other care and support systems (need to be defined)

8 18 Scoping and Financing the Bill Payment of subsidies to organisations involved in providing facilities and services (raises issues of policy, level of funding, conditions, reporting, service delivery quality assessment, etc) Unintended consequences of enforcing registration of all facilities (including those that provides a part- time programme for older person), especially possible claims to resources from the state to improve conditions and services (what type of organisations, target groups, etc qualifies for support post registration)

9 19 Scoping and Financing Issues contained in the Bill Whilst not definitively stated, the Bill requires establishment of compliance mechanism/units to ensure: –Compliance with conditions for registration of facilities –Establishment and support to residential committees for facilities –Monitoring of registered facilities or places

10 110 Scoping and Financing Issues Extension of frail care –Reporting of ill treatment and abuse to justice system, –Enquiry into accommodation or care of frail persons (processes and procedures, staffing to undertake investigations, such as social workers and other professionals) Possible increases on the number of court actions due to abuse investigations, court actions due to nature of rights granted

11 111 Scoping and Financing Issues Possible extended definition of facilities and services Establishment of a Register of abuse of older persons (reporting requirements, investigations, maintenance of register, staffing and information systems requirements, etc?)

12 112 Other Specific Concerns Section 2.2 (n) on exemption from payment of property rates taxes –Currently been considered within the annual fiscal policy framework and the municipal taxing legislation Limited but explicit role of the Provincial Executive (MEC) responsibilities for services to older persons Centralised nature of a range of all provisions within the Bill –Avoids addressing the dynamic relationship between provinces and national on service and program delivery
