3 A. A Case 1. John Peter Zenger – man thrown in jail for writing stories criticizing the local British government in America (1734) 2. A jury found him innocent since he was writing stories that were true (even though the judge wanted him guilty) 3. The jury believed people have the right to criticize the government

4 B. Why the freedom is important 1. People can express most ideas in public 2. Helps people have access to information 3. Helps people make responsible decisions 4. Free press helps bring out facts – good or bad 5. People need protection against the government (such as those who disagree or have unpopular ideas) 6. Each has the power to change our lives

6 C. Freedom of Speech 1. 1st Amendment – the government cannot pass laws taking away this 2. You can speak freely without being arrested 3. You can say what you believe is true 4. You can express your ideas by what you do – write, create signs, etc 5. You can make your ideas public - on radio, tv, internet or in public 6. You can’t break the law (ie: lie to cheat people out of money) 7. You can’t slander people (tell untruths to hurt them) 8. You can’t put people in danger (yelling fire in a theater) 9. Prior restraint – your right can’t be taken away for something you haven’t done yet!

8 D. Freedom of the Press 1. Protects newspapers, magazines, radio, tv, writers, artists and film makers 2. They can criticize the government 3. They can print the truth as they see it 4. They can print new or unpopular ideas, and may make mistakes 5. They can’t libel people - slandering someone in print! Proof is on the person who feels libeled 6. Press can’t endanger national security 7. Press can’t promote obscene material – “Community standards” – it must not offend the average person
