Liberalisation is a political decision Already made at European level in rail freight and international passenger transport Not yet decided for national transport Proposed as part of the 4th railway package The exact date is still unclear – exactly what investors do not appreciate Costs/benefits to be analyzed in concrete terms 2

3. 2. Concrete consequences In France, open access competition would mean the arrival of Deutsche Bahn/Trenitalia on a few profitable lines (Paris to Lyon…). Public Authorities could well have to make public services contracts with high speed trains operators to keep the services running. Regional Authorities will have to organise bids (every 5 to 10 years ?) 3

5. 4. « The devil is in the details » Safety and competition What rules between franchises or open access The need for inter-operable info & ticketing The terms & conditions of rail staff Essential facilities : stations, diesel pumps, sidings, maintenance… already raised for freight Public authorities will need a lot of data Don’t do a PPP without a traffic commitment etc. 5
