3 What is Section 504? Federal Civil Rights Law –Section 504 of the Rehabilitation Act of 1973 –prohibits discrimination against individuals with disabilities Intent: –Provide students with disabilities equal access to educational programs, services and activities –May not be denied participation solely on the basis of disability 11/18/2015 Accelerate Learning for Every APS Student, Every Day 3

11 Steps before Meeting 11/18/2015 Accelerate Learning for Every APS Student, Every Day 11 * Set a date within 30 days of request Send Parental Notice, Rights & Consent Notify Team Just before the meeting, assign a Notetaker

12 If determined eligible, a “504 Plan” is developed. Includes specific accommodations that will be made to ensure access to academic curriculum and extra- curricular activities and programs 11/18/2015 Accelerate Learning for Every APS Student, Every Day 12

13 Plan should include: Description of disability Major life activity limited Basis for decision, ed impact Necessary accommodations Least Restrictive Environment Review / re-eval date Names of 504 team members 11/18/2015 Accelerate Learning for Every APS Student, Every Day 13

14 Accommodations: Are reasonable adjustments, made to remove barriers; Support equal access to learning Should NOT alter or lower standards of coursework or requirements for extra-curricular activities or alter established programs 11/18/201514 Accelerate Learning for Every APS Student, Every Day

16 Accommodations usually relate to: Environment Teaching Strategies Assignments Materials Testing Behavior Health Other 11/18/2015 Accelerate Learning for Every APS Student, Every Day 16

17 Testing Student with disability should participate in standardized testing Accommodations do NOT alter content of test nor provide inappropriate assistance Accommodations should be familiar to student Testing accommodations should be documented on 504 11/18/2015 Accelerate Learning for Every APS Student, Every Day 17

18 Steps After the Meeting 11/18/2015 Accelerate Learning for Every APS Student, Every Day 18 Document in ENRICH Upload consents, attendance page, other hard copies including medical statement. Copy for parent in reasonable time Copies to staff with need to know Set a flag in Infinite Campus Copy to Cumulative File

19 Discipline? Students with 504 are expected to conform to same behavior standards as peers, unless outlined in Plan. Extra protections if faced with expulsion Team conducts Manifestation Determination If not related to disability, student receives same discipline as non-disabled peers 11/18/2015 Accelerate Learning for Every APS Student, Every Day 19

20 Field Trips Keep in Mind: Students with disabilities may not be excluded from participating in extracurricular activities solely because of their disabilities. (This may mean that no one can go, if the disabled student cannot go) 11/18/2015 Accelerate Learning for Every APS Student, Every Day 20

21 Re-Evaluation Required periodically Required for change in placement Review is recommended annually Required prior to suspending > 10 days Should be done before graduation Student should be dismissed from 504 if no longer eligible 11/18/2015 Accelerate Learning for Every APS Student, Every Day 21

22 Distribution of 504 Plan Distribute to all with a need to know (Parent, teachers, other staff) Place in student’s cumulative file Teacher to place in sub file Remember to re-distribute at quarter/semester times 11/18/2015 Accelerate Learning for Every APS Student, Every Day 22

23 Parental Rights Right to receive Parental Rights Rights to examine ed records Right to request mediation or due process hearing Right to an impartial hearing with attorney Right to file a grievance with OCR 11/18/2015 Accelerate Learning for Every APS Student, Every Day 23
