 2008 federal judge ruled that restaurants with over 15 locations must post calories on menus  Help reduce obesity  Applied to 10%  California, Oregon, and Maine with similar laws by 2009  New Yorkers eat over 1/3 of their meals out of home  First Amendment Violation?

 Consumers making better choices  Restaurants will add healthier options  People are eating out more often  Most restaurant food is high in empty calories  Ex: Whopper meal at Burger King over 2,000 calories

 Forcing restaurants to post information  Only applies to 10% of restaurants  Consumers can go elsewhere  You can inform them but they may still make poor decisions

 Transaction data from Starbucks  Calories purchased declined by 6%  Low income people in NYC vs. New Jersey  No difference in amount of purchased calories

 Calories should be required  Not a First Amendment Violation  Must be on all restaurant menus not just some  It can’t hurt anyone to be informed
