# 1 Privileges and Immunities No State can draw unreasonable distinctions between its own residents and residents of other States Must allow travel, become a citizen, use of courts, make contracts, property use

REASONABLE Distinctions include: Residency for voting & holding public office Being licensed to practice law, medicine, dentistry, teach, insurance, and so on. Others?

State colleges and universities can set higher tuition rates for out-of- staters $8,070 vs. $15,663 (2011-2012 numbers)

Another example……States require nonresidents to pay higher fees for fishing or hunting licenses! Hunting OH: $19 + $24 OH Non-Res: $125 + $24 For me to go to KY: $130 + $60 Fishing OH: $19 OH Non-Res: $40 For me to go to KY: $50

# 2 Extradition Legal process by which a fugitive from justice in one State can be returned to that State. Can a Governor refuse extradition? Yes, but RARE today

# 3 Interstate Compacts States may, with the consent of Congress, enter into agreements among themselves and with foreign states.

#4 Full Faith and Credit Recognize judicial proceedings of others states. Legal Documents, Rulings, MARRIAGE, etc…..

Defense of Marriage Act 1996 --no state is required to recognize same-sex marriage from another state (constitutional??)

2 Exceptions Exception: Civil, not criminal. States cannot enforce each others’ laws Exception: Divorce; was the divorcee a resident of the state that granted it? (Williams v. North Carolina, 1942)
