3 What is the Fair Housing Act? The Law: Outlaw discrimination in the rental or purchase of homes and a broad range of other housing-related transactions, such as advertising, mortgage lending, homeowner's insurance and zoning. (Protective Classes) The Goals: Advance equal opportunity in housing and achieve racial integration Truly integrated and balanced living patterns

5 History 1955: William Byron Rumford – first African American to serve in California State Legislature - Introduced fair-housing bill 1963: Rumford Fair Housing Act: Prohibits discrimination against basis of race, ethnicity, gender, marital status, or physical disability

6 History Continued Proposition 14: Protect property owners, as well as protect white neighborhoods & property values Reitman v. Mulkey: Supreme Court case stating that Proposition 14 violated the State Constitution Ruling: Proposition 14 violated the 14 th Amendment

7 The Legal Issues ILLEGAL- It is illegal under the Fair Housing Act to discriminate in the sale or rental of a dwelling because of the disability of (1) the buyer or renter, (2) a person who will reside in the dwelling after it is sold or rented, or (3) any person associated with the buyer or renter. LEGAL- It is not illegal, however, to refuse to rent or sell housing to an individual, with or without a disabling condition, whose tenancy would constitute a direct threat to the health or safety of other individuals or whose tenancy would result in substantial physical damage to the property of others.
