4 Government Aims for Youth Restorative Justice Meet needs of offenders Deal with their offending Prevent re-offending Just and proportionate response Re-integration to the community Meet needs of victims Reparative justice Increase participation of victims, offenders, families, communities

5 RESTORATIVE JUSTICE Is a process whereby all parties with a stake in a particular offence come together to resolve collectively how to deal with the aftermath of the offence and its implications for the future

6 With Restorative Justice offender and victim do the talking decision making is consensual power of decision making is devolved * PPS/Court make final decision

7 Legislative Criteria Aged 10 to 17 Admission or finding of guilt Consent to participate All offences, with statutory exemptions:- (a)Offences where sentence is life imprisonment (b)Offences triable only on indictment* (c) offences which are scheduled* * Court may exercise discretion

8 Youth Conference Process 1.YCC meets with offender and family/appropriate adult victim/victim representative relevant others 2. YCC arranges YC mandatory participation entitled others those who add value 3. YCC prepares report for Court made varied rejected 5. YCC monitors Order until completion deals with non-compliance

9 Youth Conference Plan Requirements Apologise Make reparation Make payment Submit to supervision of adult Perform unpaid work Participate in activities Submit to restriction Submit to treatment

10 SUMMARY Young person who has offended HELD TO ACCOUNT Families encouraged to TAKE RESPONSIBILITY Communities invited to BE INVOLVED Victims who have been affected INCLUDED Outcomes which are JUST RESTORATIVE AND EFFECTIVE
