2 2 Child Trust Account (NRS 179A.310) Established per AB 239 of 1999 Legislative Session Sponsored by then-Assemblyman Dennis Nolan Set up a special account funded by donations, gifts, and grants to pay for fingerprint-based background checks for nonprofit groups with volunteers working directly with children –Sex Offender Status –Other crimes (such as DUI) that could potentially endanger children Bureau adopted regulations to establish usage guidelines

3 Dedication, Pride, Service 3 Child Trust Account Historical Usage Child Trust Account formally established in FY 2000 Trust Account paid for State check; non-profit agency paid for FBI (national) check Historical usage low, averaging approx. 244 State- only checks per FY

4 Dedication, Pride, Service 4 Child Trust Account SB 341 Effect SB 341 of 2005 Session changed the Trust Account –Nonprofit agencies can now use Trust Account for employees and prospective employees rather than just volunteers and prospective volunteers –Nonprofit, 501(c)(3) group can serve any purpose, not just kids –Trust Account now pays for FBI background check, and Records Bureau has to “absorb” the State background check fee ($21.00/check) Records Bureau in the process of adopting regulations to incorporate changes in the law

5 Dedication, Pride, Service 5 Child Trust Account Unanswered Questions Did the Legislature intend for the Trust Account to pay for the national (FBI) background checks rather than reimburse the Bureau for the State background checks? Did the Legislature intend for the Trust Account to pay for background checks for employees? Did the Legislature intend for the Records Bureau to pay for State background checks for nonprofits not serving children?

6 Dedication, Pride, Service 6 Child Trust Account Going Forward Regulation workshop and hearing on 2/20/07 in Carson City Records Bureau to work within current statute until issues can be clarified by 2007 or future Legislative Session
