1 PUBLIC HEARING PROPOSED PROPERTY RELATED FEE FOR WATER INVESITGATION ZONE NO. 2 May 19, 2015 San Joaquin County Board of Supervisors

2 PURPOSE OF TODAY’S HEARING 2 To receive public testimony regarding proposed property related fee for Water Investigation Zone No. 2 services To receive formal protest (verbal or written) for the proposed service fee

3 WHY THE FEE IS NEEDED 4443 Water Investigation Zone No. 2 Assessment expires June 30, 2015 and a successor effort has been underway Due to recent case law, Zone 2 is proposed as a property related fee, rather than a benefit assessment The implementation of your Board’s adopted 2015 Strategic Plan to Meet Water Needs requires a funding source to continue services Includes all parcels countywide Designated an “Investigation Zone” Limited to Water- related Planning, Investigations and Studies Funding for staff, special water counsel, & consultants Originally established on an Ad Valorem basis $0.00336 per $1.00 of Assessed Property Value Approvals of Zone 2 through 2000 made in the pre-Proposition 218 era 3

4 FEE STRUCTURE 4 Fees must be apportioned to properties by their use of water system Land use type, as well as number of acres and estimated population per property were calculated to determine the fee per property Annual fee adjustments can only be approved for a period of 5 years and are based on the annual CPI, not to exceed 3% annually

5 PROPOSED ZONE NO. 2 FEE 5 Zone No. 2 = 217,699 Eligible Parcels Countywide Total FY 2015-2016 Zone 2 Revenue = $1.25 Million 5

6 PROTEST PROCESS 6 Written protests must be received prior to 12 o’clock noon today Verbal testimony must be voiced during today’s public hearing Total written protests received determines outcome Only one protest per parcel may be registered Property owner may rescind prior protest

7 PROTEST TABULATION PROCESS 7 All protests received prior to the Public Hearing were time-stamped and logged in a database by Assessor’s Parcel Number (APN) All submitted protests were validated, tabulated and included in the total by each committees consisting of staff and consultants Protests received before 12 noon on May 19, 2015 will be added and included in the total tally 7

8 IF PROTESTING ZONE NO. 2 FEE 8 Please provide: Your Name Property address and/or Parcel Number NOTE: Protests from anyone other than a property owner or authorized representative will not be tabulated All verbal protests must be accompanied by a written protest before the close of the hearing

9 RECOMMENDATION 9 Open the Public Hearing Receive testimony & any protests for the proposed Water Investigation Zone No. 2 Property Related Fee Close the public hearing After tabulation of protests received, Public Works will make final recommendations 9
