3 Land in Uganda  The Uganda Constitution recognizes four (4) tenure systems namely: a) Mailo b) Freehold c) Customary d) Leasehold The presentation is based on data from the Land Information System (LIS); and data from the Justice, Law and Order Sector (JLOS).

4 The Land Information System (LIS)  In Feb 2013, Government of Uganda launched the Land Information System.  It was piloted in six MZOs of Mbarara, Masaka, Jinja, Wakiso, Mukono and Kampala; and MLHUD/HQ to serve the rest of the country. It was also installed at SMD and NLIC.  The LIS development process involved:  Rehabilitation and digitization of existing land records and cadastral maps:  500,000 Titles  16,500 Maps  Provision of the base map covering 17,362 sq.km  Upgrade of the working environment and supporting system tools for 6 Ministry Zonal Offices (MZOs) and National Land Information Centre (NLIC)

5 Commitment/Verification Exercise  The non-committed files in the system causes delay in service delivery.  This is the due diligence exercise of reconciling the physical and digital information in the system.  This limits the direct use of digital information thus leading to delays in service delivery.  However, for land records that have already been verified, the hard copies of the documents are not required during processing of transactions, thus leading to a reduction in the number of days and time taken to register a transaction.

6 Percentage committed per MZO  The commitment exercise has a negative effect on performance of the LIS. The verification/commitment exercise was carried out in Jinja, Mbarara and partly in Wakiso MZOs. 7 Type of owners of registered parcels  87% of the registered parcels are singly owned while the remaining 13% have multiple ownership.  Based on 79% of the data, 44% of the registered land parcels are owned by male,13% are owned by female and 10% owned by companies.  If we exclude the missing information, 56% of the registered land is owned by male while 16% is owned by female. 13% is then owned by companies of which 9% represents Government land and parastatals. 9 Registered transactions in LIS March 2013 – December 2014  The major transactions received and registered under the LIS include: Transfers of title (Mailo, Freehold & Leasehold); Searches; Registering of mortgages; and first time registrations (conversions). These combined account for 71% of the transactions received and registered. The average number of days taken to register a transaction under the LIS is between 19 – 38 days.

17 Resolving Land Disputes  Government of Uganda is in the process of appointing a multi-sectoral Committee to spearhead the :  Review of the Judiciary rules and procedures for land dispute resolution to identify gaps and recommend improvement;  Comprehensive review of the legal, institutional and operational framework of land tribunals to identify gaps and make recommendations for improvement;  Compilation and disseminating materials on land laws and related documents;  Process of strengthening the capacity of the judiciary and the land sector to implement ADR and mediation programs; and  Provision of training to the judiciary and other land dispute resolution institutions.

18 Other attempts between the Ministry & JLOS  An inception stakeholder’s workshop was held on 25 th July, 2014. it was aimed at introducing staff of the Judiciary, JLOS, Ministry of Justice and Constitutional Affairs and other key stakeholder to the Land Dispute Resolution Component under the new Competitiveness and Enterprise Development Project.  Outputs during of the workshop:  Many misunderstandings between the Judiciary and MLHUD were identified and ironed out.  It was also agreed that there should be closer cooperation amongst the Traditional Institutions, MLHUD and the Judiciary for improvement of service delivery and reduction in court case backlog.

19 Next steps  Rolling out of the National Land Information System to the remaining 15 zonal offices to cover the whole country and improve service delivery  Developing a revised system incorporating the aspects of Physical Planning and Valuation; and granting corporate access to key stakeholders (corporate bodies) for easy retrieval of information.  Reviewing the Ministry’s Clients’ Charter and ensuring adherence to the stipulated fees and days  Developing key monitoring indicators for the sector in order to measure performance and progress
