1 Sample Essay  In an essay, explain how you think a court would settle the conflict below by answer the following questions.  What two types of laws are in conflict?  How would the Supremacy Clause settle the dispute?  What arguments can the Governor use to defend his order?  Is the Governor’s argument strong enough for the court to make an exception to the constitutional rule?  As Hurricane Bubba approaches the west coast of Florida, reporters from the Weather Channel rush to the scene to provide on the scene coverage. The governor of Florida issues a mandatory evacuation order of all coastal areas up to 40 miles inland. The reporters are arrested for violating the order. They file suit claiming their 1 st amendment rights have been violated.

2 What is a grant?  Federal money given to states or local communities to address important issues.  What is the biggest problem facing Bloomington / Normal?  What “strings” can we attach?

3 What will I learn today?  I can explain what cooperative federalism is.  I can identify the differences between block, project and categorical grants.  I can identify the obligations the federal government has towards the states.

4 Federal Grants recovery.gov recovery.gov Categorical Grants  Categorical grants are made for some specific, closely defined purpose, such as school lunch programs or the construction of airports or water treatment plants. There are usually conditions, or “strings,” attached to regulate the use of these funds. Project Grants  Project grants are provided to States, localities, and sometimes private agencies that apply for them. They are used for a variety of purposes ranging from medical research to job training and employment programs. Block Grants Block grants are portions of money allocated to States to use for broader purposes, such as health care, social services, or welfare. Block grants often are granted with fewer strings attached. Congress appropriates money for three types of grants-in-aid:

5 The Nation’s Obligations to the States: Article IV Republican Form of Government  The Constitution requires the National Government to “guarantee to every State in this Union a Republican Form of Government.” Invasion and Internal Disorder  The National Government is also required to provide defense of the States from foreign invasion, and aid in protecting against “domestic Violence” in the States. Respect for Territorial Integrity  The National Government is constitutionally bound to respect the territorial integrity of each of the States.

6 Unit #3 Exam Preview  Matching sections: Types of powers, basic principles of the Constitution, and sections of the Constitution.  Know the clauses: Necessary and Proper, Full Faith and Credit, Supremacy Clause.  Be able to identify a check that each branch has over the other two.  Essay: Applying the Supremacy Clause. We have done this in class twice.  Multiple Choice topics: All of the above, amendment process (formal and informal), national obligations to states, types of grants.
